Resolution 1960Member Kemper _introduced the following resolution and moved
its adoption:
RESOLUTION LIMITING CONSTRUCTION OF
EXTENSIONS TO THE SANITARY SE14ER SYSTEM
TO VILLAGE CONTRACTORS
Whereas, there has been heretofore no policy established by this
council relating to the construction of extensions to the sanitary sewer
system, and
Whereas, the construction of extensions to the sanitary sewer system
by private contractors not under contract with the Village of Elk River,
cannot be adequately inspected by the Village of Elk River, its engineers,
or agents, a fact that will result in lack of uniformity in the system and
non-complian e with certain specifications deemed advantageous to such
construction by the council,
110141 THEREFORE BE IT RESOLVED, that no extension to the sanitary
sewer system, except private connections, shall be constructed by persons,
companies or corporations not directly or indirectly under contract with
the Village of Elk River to perform such construction; and that construction
of such extensions except in conformity with this resolution shall be
deemed unlawful, and subject to termibation or injunction by appropriate
action of this council and courts of competent jurisdiction. Nothing con-
tained in this res&-Ition shall be deemed in any manner to limit such con-
struction by employees of this council and Village where permitted by law.
This resolution shall be effective from the date o; its adotpion. r
