MEMORANDUM TO: FROM: Mayor and City Council Michele MCPherso~ector of Planning DATE: July 18, 2005 SUBJECT: Case No. ZC 05-01 Request by the City of Elk River for Zone Changes of Multiple Parcels Request The City Council is asked to consider rezoning multiple parcels within the City of Elk River in order to achieve consistency between the adopted Land Use Map and the Zoning Map. Ordinance No. 05 - _a Background On June 20, the City Council considered zone changes for nine parcels within the City of Elk River in order to bring the Land Use Map and Zoning Map into consistency with each other. This zone change did not include parcels within the Commercial Reserve nor the Old Town land use area. Each of these areas requires new official controls to be drafted prior to changes in the Zoning Map. The City Council requested that the Specht family be notified of the proposed zone change. A copy of the letter that was sent to them is attached. As of the writing of this memo, staff has not been contacted by a representative of the Specht family. Memo to the Mayor and City Council/ZC 05-0 I July 18,2005 Page 2 The Mayor, during the Gateway Business Center discussion on Monday, July 11 inquired as to the land area of the commercial and business park areas on the Specht property. The commercial area is approximately 44 acres and the business park is 133 acres. Commercial Industrial Recommendation Staff and the Planning Commission recommend that the City Council approve the zone changes with the following findings: 1. The zone change will be consistent with the Land Use Map. Z. The zone change will not adversely impact adjacent parcels. 3. The zone changes promote the vision stated within the City's Comprehensive Plan. There are two parcels (#6 and #8) still outstanding that were included in the original zone change request. They now have related land use amendments requested by the Planning Commission and will be considered by the City Council at their August 15, Z005 meeting. Our. family has known t.he Specht family for over 50 years. My father sold Erwin Specht one of his first school buses. I rode 011 his bus when I went to school. The Specht family has lived and farmed in this community for nearly 80 years and has served this com- munity safely with school bus~s . for nearly 50 years. I cannot believe these honor- able people who have 50 years of experience can be so remiss in their performance that it merits cancellation of their contract just one month before school starts.
