The City Council is asked to consider rezoning multiple parcels within the City of Elk River
in order to achieve consistency between the adopted Land Use Map and the Zoning Map.

Background
On June 20, the City Council considered zone changes for nine parcels within the City of
Elk River in order to bring the Land Use Map and Zoning Map into consistency with each
other. This zone change did not include parcels within the Commercial Reserve nor the Old
Town land use area. Each of these areas requires new official controls to be drafted prior to
changes in the Zoning Map.
The City Council requested that the Specht family be notified of the proposed zone change.
A copy of the letter that was sent to them is attached. As of the writing of this memo, staff
has not been contacted by a representative of the Specht family.

The Mayor, during the Gateway Business Center discussion on Monday, July 11 inquired as
to the land area of the commercial and business park areas on the Specht property. The
commercial area is approximately 44 acres and the business park is 133 acres.

Recommendation
Staff and the Planning Commission recommend that the City Council approve the zone
changes with the following findings:
1. The zone change will be consistent with the Land Use Map.
Z. The zone change will not adversely impact adjacent parcels.
3. The zone changes promote the vision stated within the City's Comprehensive Plan.
There are two parcels (#6 and #8) still outstanding that were included in the original zone
change request. They now have related land use amendments requested by the Planning
Commission and will be considered by the City Council at their August 15, Z005 meeting.

NOTICE OF PUBLIC HEARING
The Elk River Planning Commission will conduct a public hearing on Tuesday, May 24, 2005 at 6:30
p.m. at Elk River City Hall, 13065 Orono Parkway, to consider a request by the City of Elk River to
rezone multiple parcels to be consistent with the Comprehensive Plan, Case No. ZC 05-01.
The Elk River City Council will also conduct a public hearing concerning this matter Monday, June
20, 2005 at 6:30 p.m. at Elk River City Hall, 13065 Orono Parkway.
A map of the affected properties is available for review at Elk River City Hall and also on the City's
website at: www.ci.elk-river.mn.us. The affected properties are described as follows:
Parcel #1; Rezone from C3 Highway Commercial to 11 Light lndustrial- Triangular-shaped parcel
owned by Great River Energy located north of US Trunk Highway 10 and 165th Avenue. Legal
description is: That part of the Southwest Quarter of the Southeast Quarter of Section 11, Township
32, Range 26, Sherburne County, Minnesota which lies Southwesterly of the following described line.

In 2004, the City of Elk. River adopted a new Comprehensive Plan. In that Comprehensive
Plan, property you own was been re-guided from Low Density Residential to a combination
of Commercial, Industrial and Open Space (see enclosed land use map).
In order to bring the City's Zoning Map into compliance with the new land use designations,
the City of Elk. River is processing a Zoning Map Amendment. This map amendment would
change the zoning classification of your property from Residential to both Commercial and
Business Park, with the remainder remaining Residential. The City Council will discuss this
issue at their July 18, 2005 City Council meeting. You are invited to attend if you desire.
While the zoning of the property is proposed to be changed, you may continue to utilize the
land as you do today with no impact or prohibition of its current use.

AN ORDINANCE AMENDING THE
CITY OF ELK RIVER ZONING MAP TO REZONE MULTIPLE PARCELS AS
DESCRIBED IN ATTACHED EXHIBIT A

The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone the properties described as:
See Attached Exhibit A
Section 2.
The rezoning is being approved based on the following findings:
1. THE ZONE CHANGE WILL BE CONSISTENT WITH THE LAND USE MAP.
2. THE ZONE CHANGE WILL NOT ADVERSELY IMPACT ADJACENT
PARCELS.
3. THE ZONE CHANGES PROMOTE THE VISION STATED WITHIN THE

I was shocked and disturbed
to read in this paper that the
Specht Bus Service contract
)Vith Disirict 728 was can-
celled. Our. family has known
t.he Specht family for over 50
years. My father sold Erwin
Specht one of his first school
buses. I rode 011 his bus when I
went to school. The Specht
family has lived and farmed in
this community for nearly 80
years and has served this com-
munity safely with school

I cannot believe these honor-
able people who have 50 years
of experience can be so remiss
in their performance that it
merits cancellation of their
contract just one month before
