Members Present: Chair Eric Johnson, Commissioners Perry Beise,Alexander Feinstein,
John Jordan,Jill Larson-Vito, Robert Rydberg, and Brad Thiel
Members Absent: None
Also Present: City Councilmember Nate Ovall
Staff Present: Planning Manager Zack Carlton, Senior Planner Chris Leeseberg, and
Sr. Admin. Assistant/Recording Secretary Jennifer Green
I. Call Meeting to Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of
Adjustments was called to order at 6:3Q .m. by Chair,,ohnson.
2. Roll Call
Roll call was taken.
3. Consider April 28, 2020, Board of Adjustments Agenda
Moved by Commissioner Larson-Vito and seconded by Commissioner
Feinstein to approve the April 28, 2020, Board of Adjustments agenda.
Motion carried 7-0.
4. Consider December 17, 2019, Board of Adjustments Minutes
Moved by Commissioner Larson-Vito and seconded by Commissioner
Feinstein to approve the December 17, 2019, Board of Adjustments minutes.
Motion carried 7-0.
5.1 Robert Jahn — 181 1 1 Concord St. NW
■ 5' Front Yard Setback Variance, Case No. V 20-01
Mr. Leeseberg presented the staff report. He provided the public with contact
information either via email or phone for comments or questions regarding this
request.

Chair Johnson opened the public hearing.
Commissioner Larson-Vito asked if there were any comments received from
neighboring property owners.
Mr. Leeseberg stated he received one question but no other comments or concerns.
There being no comments received either prior to the meeting or during the public
hearing portion by contacting staff, Chair Johnson closed the public hearing.
Moved by Commissioner Larson-Vito and seconded by Commissioner Jordan
to approve the variance request by Robert Jahn for a 5' front yard setback on
the property located at 18111 Concord Cir. NW as the following criteria,
required for approved, are satisfied:
1. The general purpose and intent of the ordinance are met.
2. The property has a land use of residential and the use is consistent
with the Comprehensive Plan.
3. The proposed use is reasonable and is permitted in the zoning
ordinance.
4. The plight of the petitioner is due to circumstances unique to the
property not a consequence of the petitioner's own action or
inaction.
5. The variance will not alter the essential character of the locality.

Any appeals to this variance approval need to be turned in by May 8, 2020, to be
reviewed at the May 18, 2020, City Council meeting.

There being no further business, Chair Johnson adjourned the meeting of the Elk
River Board of Adjustments at 6:39 p.m.
