04-06-1953 VCM VILLAGE OF ELK RIVER COUNCIL MEETING April 6, 1953 A regular meeting was held at the Municipal Building on Apr 6, 1953. Members present: E.A. Parent, Mayor; Harry Dow, Dan Bailey, August Meyer, Trustees; H.A. Briggs, Clerk The meeting was called to order by Mayor Parent. The minutes of the last meeting were read and approved. A motion was made by Dow and seconded by Bailey to transfer $83.00 from the General Fund to the Library Fund to offset purchase of a used typewriter for the library which was paid for out of the Library Fund. Carried. A motion was made by Briggs and seconded by Meyer to approve application of Wm Schumacher for an on and off beer license. Carried. A motion was made by Briggs and seconded by Dow to send Les Derr to the Fire School at St. Paul thst April 27 to May 1 1958. Motion carried. A motion was made by Meyer and seconded by Bailey to authorize the Elk River Village Fire Department to answer fire calls outside the village limits as well as in the village. The motion carried. At this council meeting the hearing regarding the matter of vacating certain streets in the Walker Addition Revised was held. No one appeared in answer to the notice of the hearing. Briggs Clerk Resolution RESOLUTION OF THE VILLAGE COUNCIL, VILLAGE OF ELK RIVER, MINNESOTA VACATING CERTAIN STREETS AND ALLEYS In the Matter of the Vacation of Streets and Alleys in Walker’s Addition to the Village of Elk River: th WHEREAS the above entitled matter came on to be heard on the 6 day of April, 1953, at 8:00 P.M. before the Village Council of the Village of Elk River, Minnesota, in the Municipal Building in said Village upon the petition duly filed by Elk River Home and Improvement Company for the vacation of the following described streets and alleys in said Village, to-wit: Ninth Street, Elm Street, and all unnamed streets and alleys as laid out in the Plat of Walker’s Addition to the Village of Elk River, dated July 18, 1946 and filed for record on said date in the office of the Register of Deeds in and for Sherburne County, Minnesota. WHERAS due notice of said hearing by published and posted notice as required by law has been given by said Village Council, and the petitioners appeared in support of said petition and no one appeared in opposition thereto, and, WHEREAS said Village Council has heard the evidence in favor of said petition, that the petitioners and other persons who signed said petition are the owners of all lands adjoining and abutting said streets and alleys, and that the said streets and alleys are not now nor in the foreseeable future will be used for any public purpose, and that it would be to the best interest of the public to vacate said streets and alleys, and WHEREAS Councilman Bailey introduced the resolution hereinafter set forth and moved its adoption, which said resolution was duly seconded by Councilman ____, and said resolution having been put to a roll call vote the following members of said Council voted aye: Bailey, Dow, Meyers, Briggs The following members voted nay: none; whereupon said resolution was declared adopted by the President of said Council; NOW THEREFORE BE IT RESOLVED, by the Village Council of the Village of Elk River, Sherburne County, Minnesota that the following streets and alleys shall be and hereby are forever vacated and closed, to-wit: RESOLUTION OF THE VILLAGE COUNCIL, VILLAGE OF ELK RIVER, MINNESOTA VACATING CERTAIN STREETS AND ALLEYS Ninth Street, Elm Street, and all unnamed streets and alleys as laid out in the Plat of Walker’s Addition to the Village of Elk River, dated July 18, 1046 and filed for record on said date in the office of the Register of Deeds in and for Sherburne County, Minnesota. th Dated at Elk River, Minnesota this 6 day of April 1953.
