RESOLUTION 91 - 32
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ACCEPTING BID AND AUTHORIZING
EXECUTION OF CONTRACT IN THE MATTER OF THE
PROCTOR AVENUE IMPROVEMENT OF 1991
WHEREAS, pursuant to Resolution 91-19, competitive bids were
solicited and received for the Proctor Avenue
improvement as set forth in the bid tabulation
attached hereto and incorporated herein by this
reference; and,
WHEREAS, the City Council has considered the amount of the bids
and the responsibility of the bidders and determined
that R.L. Larson Excavating, Inc., is the lowest
responsible bidder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River, Minnesota:
1.
The Mayor and City Administrator are authorized and
directed to execute, on behalf of the City, such
contract with R.L. Larson Excavating, Inc., as is
approved by the City Attorney for the completion of
the Proctor Avenue improvement according to the
approved plans and specifications designated in
Resolution 91-19. Execution of said contract is
contingent on concurrence of the City's action by the
Sherburne County Board of Commissioners.

The City Administrator is directed to relay to the
Sherburne County Board of Commissioners the action
undertaken by the City Council and request their
concurrence.
3.
The City Administrator is authorized and directed to
forthwith return to all bidders the deposits made with
their bids upon execution of the contract above
specified.
