RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RELATING TO FINDING OF PUBLIC PURPOSE
FOR THE ACQUISITION OF RIGHT-OF-WAY AND EASEMENTS FOR
PROCTOR AVENUE
WHEREAS, a roadway, commonly known as Proctor Avenue or County
Road 1, located within the City of Elk River has been
used by the general public as a thoroughfare; and,
WHEREAS, Sherburne County, in cooperation with the City of Elk
River, directed the preparation of a feasibility study
to upgrade and improve Proctor Avenue between the
areas of Highway 10 and just past the "wye"
intersection of CSAH #1 and County Road #77 (the
Improvements) and held a public hearing pursuant to
Minnesota Statutes Section 429 ~~seg~, to consider
ordering improvements to Proctor Avenue; and,
WHEREAS, the City Council of the City of Elk River, at its
meeting of May 16, 1991, adopted Resolution 91-31
ordering the public improvement for Proctor Avenue;
and,
e
WHEREAS, the City Engineer has determined the nee1 for
additional right-of-way to construct the Improvements;
and,
WHEREAS, the City Council of the City of Elk River has
determined that the Improvements and need for
additional right-of-way for roadway and sidewalk
easements are in the public interest.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River, that the City acquire the right, title
and interest in certain property generally described
on the attached Exhibit A, pursuant to Minnesota
Statutes Section 117 et:_~~<L.. for the public purpose
of constructing the Improvements to Proctor Avenue.
