Dan Tveite Statement and Determination, as President of the The Economic Development
Authority for the City of Elk River Minnesota Regarding Conducting Meetings by Telephone
or Other Electronic Means
As President of the The Economic Development Authority for the City of Elk River Minnesota (the
“EDA”), Minnesota, I find as follows:
a.The spread of COVID-19 in the United States and Minnesota has raised serious public health
concerns and resulted in a great deal of uncertainty. Much remains unknown about the virus
and how it spreads.
b.On March 11, 2020, the World Health Organization determined that the COVID-19 outbreak
constitutes a pandemic. On March 13, 2020, President Trump declared a national state of
emergency as a result of the pandemic.
c.On March 13, 2020, Governor Tim Walz issued Emergency Executive Order 20-01 declaring
a state of peacetime emergency to address the COVID-19 pandemic in Minnesota. The
Governor’s Executive Order triggered activation of the County’s emergency management plan
and enabled the County to exercise its emergency powers.
d.Mayor John Dietz of the City of Elk River, Minnesota declared a local emergency due to the
COVID-19 pandemic in Minnesota.
e.On March 26, 2020, City Administrator Cal Portner declared that until further notice, or until
such time as the State of Minnesota determines to no longer be in a state of emergency, all
meetings of the EDA governed by Minnesota Statute, Section 13D shall be conducted by
telephone or other electronic means.
f.Minnesota Statutes, Section 13D.021 authorizes cities and other public bodies to meet by
telephone or other electronic means if the presiding officer, chief legal counsel, or chief
administrative officer determines that meeting in person or by interactive television is not
practical or prudent because of a health pandemic or an emergency has been declared. I
have consulted with the EDA’s chief legal counsel and chief administrative officer.
Based on the above findings, I determine as follows:
1.In accordance with the declarations of the Mayor and the City Administrator, until further
notice, all meetings of the EDA may be conducted by telephone or other electronic means in a
manner satisfying the requirements in Minnesota Statutes, Section 13D.021 and the
declarations of the Mayor and the City Administrator.
2.As is practical and feasible, the EDA will provide notice of how the public may listen to or
view meetings as they are being conducted, and the EDA will continue to make recordings of
its meetings available to the public.
3.All votes occurring at meetings in which all or some of the members are participating by
telephone or electronic means will be conducted by roll call.

Pursuant to due call and notice thereof, the meeting of the EDA Beautification Committee
was called to order at 10:02 a.m.
2. Consider Agenda
Motion by Bakken and seconded by McCormick to approve the agenda. Motion
carried 3-0.
3.0 Consent Agenda
Motion by McCormick and seconded by Bakken to approve the consent agenda.
Motion carried 3-0.
4.1 Review City Beautification Applications
Ms. Eddy presented the application and confirmed the nomination description. Members
completed the judging rubric.
Motion by Magnussen and seconded by Bakken to award CHOW Mixed Grill with
the award for making substantial improvements to the exterior of their building
and/or landscape in the last year. Motion carried 5-0.
4.2 Marketing and Promotion
Ms. Eddy presented the staff report. A flyer was created, Instagram platform is too new to
utilize at this time. Staff is working with communications department on posting on social
media sites. As far as networking groups, the chamber can be utilized as a resource, and
members discussed distributing the flyer at various networking groups and tagging winners
on Facebook.

Motion by Hardin and seconded by McCormick to approve the agenda. Motion
carried 3-0.

Motion by Ackerman and seconded by Hardin to approve the consent agenda.

4.1 Beautification Policy Review
Ms. Othoudt presented the staff report. The group discussed a couple revisions. It was
suggested to have the award be a $100-$125 gift card at Spikes. That way the award recipient
would be able to pick out an item that made sense for their business.
5.1 Announcements
The group discussed a couple people to fill the committee vacancy.

Motion by Ackerman and seconded by Hardin to adjourn the meeting at 10:37 a.m.

Review the EDA City Beautification Award application and provide a recommendation to the EDA.
Background/Discussion
The City of Elk River Beautification Committee seeks to recognize commercial/industrial site
improvements, commercial/industrial upgrades, landscapes, renovations, restorations, and new structures
that are architecturally noteworthy.
A major criterion is how the project visually enhances the surrounding neighborhood and community.
How the business incorporates design, maintenance, color, organization and creativity within the existing
community. Improvements to structures, interior/exterior spaces and the landscaping are important
elements for consideration.
Plaisted Companies, Inc. recently remodeled their Outdoor Landscape Supply Showroom area. This
Outdoor Showroom is a great display area for both homeowners and contractors to come for ideas for
outdoor hardscaping products. Plaisted is very proud of the work that was done in this area. The display
showcases several brand names including: Borgert, Belgard, Rochester, Stoneworks, Summerset Grills &
Plaisted Companies products.

City Beautification Award Policy
What is the City Beautification Award?
The City Beautification Award recognizes business owners whose efforts to clean, repair,
improve and enhance the overall aesthetics of either the interior or exterior of the business,
property and/or space thereby maintaining the beauty of their neighborhood and
surroundings. It is presented to encourage community improvements, enhance our city’s
image and economic vitality.
From May through October, The Beautification Committee will accept nominations from
the public and/or self-nominations. Nominations meeting the judging rubric of the
Beautification Award will become finalists. All finalists will receive public recognition for
making and continuing to help keep the City of Elk River beautiful!
Businesses can be nominated for this award by others within the community or they may
nominate themselves (self-nomination is encouraged!). Award finalists will be shown in
promotional materials.
In November of each year, the Beautification Committee will select one of the finalists to be
awarded The City Beautification Award. The City Beautification Award Recipient will
receive the award at the following EDA meeting presented by the EDA President and a
member of the Beautification Committee. In addition, award recipient will be recognized by
the Mayor and City Council at their November meeting.
What does the Beautification Committee look for?
The City of Elk River Beautification Committee seeks to recognize commercial/industrial

Applications will be evaluated based on the overall visual appearance of the completed
project.

Application Requirements
1. Submit completed entry form plus at least two high-quality digital photos, including a
“before” if available and “after” (if applicable) by the first Monday of each month
beginning in May through October of each year.
2. Deliver via email by the end of the business day on the first Monday of the month:

Eligibility
Site must be located within the City of Elk River corporate limits.
Self-nominations are encouraged!
A photo release approval will be needed to authorize the use of photos in various
social media and print forums.
For new construction or renovations, a certificate of occupancy must have been
issued.
Public projects are not eligible.
Previous recipients of The City Beautification Award are ineligible to receive the
award in the succeeding two years at the same location.

Judging Rubric
This award recognizes business, property and/or spaces that contribute to the beautification
of the city through landscaping and architecture. Applicants need to score a minimum of 10 points
in order to qualify as a finalist.
