Tralle, Mayor RESOLUTION 91 - ~ RESOLUTION FOR THE CITY OF ELK RIVER e r A RESOLUTION ESTABLISHING CONSTRUCTION DEBRIS LANDFILL FEE . WHEREAS, the City of Elk River (the City) is a Minnesota municipal corporationj and, WHEREAS, the 1991 regular session of the Minnesota Legislature amended Minnesota Statutes Section 115A.921 to authorize a city or town to impose a fee of $.50 per cubic yard of waste or its equivalent on operators of facilities for the disposal of construction debris located within the city or townj and, WHEREAS, there is located within the City of Elk River a facility for the disposal of construction debris. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River: 1. The fee due from an operator of a demolition debris disposal facility within the City of Elk River shall, effective October 1, 1991, be twenty-five cents ($.25) per cubic yard of waste or its equivalent, as defined in Minnesota Statutes Section 115A.921. 2. The fee due from an operator of a demolition debris disposal facility shall be paid to the City Treasurer on the 15th day of each month, no later than one month after the end of the month of acceptance of debris by the facility operator and disposed of on land within the City. e 3. The maximum revenue that may be collected under this subdivision must be determined by multiplying the total permitted capacity of a facility by 15 cents per cubic yard.
