RESOLUTION FOR THE CITY OF ELK RIVER
DECLARING THE CITY'S INTENT TO REQUIRE NONCONFORMING
SEPTIC SYSTEMS TO BE UPGRADED IN THE SHORE LAND DISTRICT
WHEREAS, the City of Elk River is mandated by the State to
implement a program to eliminate nonconforming septic
systems from the Shore land District; and,
WHEREAS, the City of Elk River desires to eliminate this source
of contamination.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River, that the City will check the conformity of septic
systems at time of building permit issuance or zoning approval
and make upgrading of septic systems mandatory to approval of
those permits. The City will also immediately deal with
nonconforming septic systems when they are reported or other
problems arise associated with them. Finally, as time and
funding permits, the City will research back records to
identify nonconforming systems and require them to be upgraded.
Passed and adopted by the Elk River City Council this 18th day
of November, 1991.
