Background/Discussion The HRA entered into a purchase agreement on August 5, 2019, and closed on the property on September 13. Following the purchase and before demolition, the sellers were to remove a stained-glass window. Staff contacted the sellers and asked them to remove the window on November 18, 2019. On November 26, 2019, staff met with the sellers onsite and noticed the window was missing. A police report was filed and a couple leads did not come to fruition. The sellers requested an insurance claim form on December 31. The form was sent on January 2, 2020, to return it to the city for processing. The sellers submitted the form directly to our insurance provider LMC-IT on March 11, 2020. The LMC-IT informed staff they are not able to process the claim because it was received by a third party and not the city. The LMC suggested we work with the previous owners directly to settle the issue. The LMN-IT researched and provided five similar stained-glass windows for sale. The average cost of those windows was used to negotiate a fair value with the sellers. Financial Impact Payment to the sellers of$526 to come from the Main/Gates Redevelopment project budget,releasing all claims against the HRA or the city relating to the property or the stained-glass window. Mission/Policy/Goal The goal of the HRA is to acquire properties along Main St. NW, Gates Ave. NW and 3rd St. NW as part of a redevelopment project initiated by Mississippi Connections Plan. The project will improve trail connectivity through the area and into downtown Elk River. We entered into a purchase agreement with the Housing and Redevelopment Authority of the City of Elk River (the "HRA") on August 5, 2019 to sell the Property to the HRA. The HRA is now the owner of the Property. The HRA agreed in the Purchase Agreement as part of its purchase of the Property that we could remove the stained-glass window from the building on the Property. Removal was to be completed after the closing on the Property prior to demolition. The stained-glass window was subsequently stolen from the Property. In consideration for releasing any claims that we may have against the HRA or the City of Elk River relating to the Property or the stained-glass window, the HRA has agreed to pay us $526.00. We hereby acknowledge receipt of this payment from the HRA. In exchange for this payment, we hereby fully and completely release, acquit, and forever discharge the HRA and the City of Elk River from any and all liability for any and all damages, actions, or claims, regardless of whether they are known or unknown, direct or indirect, asserted or unasserted, that are related to the stained glass window on the Property or the Property.
