A Resolution of the City Council of the City of Elk River Amending the
Comprehensive Plan to Swap Industrial and Open Space Land Use
Designations on Two Parcels.
WHEREAS, application has been made for a Comprehensive Plan amendment to swap
industrial and open space land use designations to facilitate future development of the Youth
Athletic Complex and adjacent industrial parcels owned by Copart of Connecticut, and
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2, prescribes the procedure
for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public hearing on August 12, 2020, and
recommended approval regarding the Comprehensive Plan amendment request for the
property described in Exhibit A, and
WHEREAS, the City Council has reviewed the Comprehensive Plan amendment request
and finds the following:
1. The proposed land use swap better facilitates development of the surrounding and
subject parcels.
2. The proposed land use is consistent with the surrounding land uses.
3. The use will not have adverse impacts on the surrounding land uses.
4. The proposed changes are in general conformance to the adopted Comprehensive
Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows: The Land Use Plan be amended to change the land use
designations as depicted in Exhibit A.
Passed and adopted this 17`' day of August 2020.
