CITY OF ELK RIVER
AN ORDINANCE AMENDING THE CITY OF ELK RIVER
ZONING MAP TO REZONE CERTAIN PROPERTY
FROM
R1E (SINGLE FAMILY RESIDENTIAL)
TO
PUD (PLANNED UNIT DEVELOPMENT)
CASE NO. ZC 94-05
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is
hereby amended to rezone the property described as:

That part of the south 928.55 ft. of the SW 1/4 of the NE 1/4 Section 27,
Township 33, Range 26, Sherburne County, MN, lying west of Hillside Estates
1st Addition and lying east of Highway 169. Parcel of land lying north of above
mentioned legal description, extending easterly line of above mentioned legal
description 50 ft. from that point westerly to a point lying northerly of west line
of above mentioned legal description extended 100 ft. containing 1.07 acres plus
or minus,
from RIE (Single Family Residential) to PUD (Planned Unit Development) based
on the following findings:
1. The rezoning will be consistent with the Comprehensive Land Use Plan
designation of HB (Highway Business).
2. The rezoning is a minor extension of the existing commercial zoning and
land use designation, and will not adversely impact the surrounding
properties.
3. The rezoning is consistent with the existing Growth Management Plan
whereby commercial is anticipated to be extended north to 197th Avenue.

Section 2. That this Ordinance shall take effect and be in full force from
and after the date of its publication.
