Action Requested
Adopt, by resolution, the final plat of TRIE Addition with the following conditions:
1. The shed crossing the shared property line shall be relocated to meet setback requirements or removed.
2. The existing driveway shall be relocated in a manner acceptable to county and city setback requirements.
3. Park dedication shall be satisfied per the Parks and Recreation Commission recommendation from their
September 9, 2020, meeting.

The subject property, six acres in size, zoned Rla and is west of County �Y
Road 1 and south of 207`' Avenue. The plat includes two lots, an Outlot, f
and dedication of public right-of-way. Lot 1 (2.52 acres) will contain the
existing house. Lot 2 (2.5 acres) will become a new developable lot. Both cc
parcels meet the size and width requirements for the R1a zoning district. •' ca 33

An accessory structure (shed) crosses the shared property line and is I ;'
located within the minimum building setback requirements. This shed zV
will need to be relocated or removed. �j

The Lot 1 driveway crosses over a portion of Lot 2 and the preliminary Hwy 10
plat indicates a proposed 16-foot driveway easement. Staff has concerns CR 12
with shared driveways as they often become contentious for future
property owners. The existing driveway should be relocated in a manner
acceptable to the county while also meeting city setback requirements.
Parks and Recreation Commission
The Parks and Recreation Commission will review this plat for park
dedication during their September 9, 2020 meeting.

1. The proposed subdivision is consistent with the honing regulations (article VI of this chapter) and conforms in all respects
with all requirements of this Code, including the honing regulations and this article.
The property is zoned R1-a (single family residential) and the proposed subdivision is consistent with all
zoning regulations.
2. The proposed subdivision is consistent with all applicable general and specialized cio, county, and regional plans, including
but not limited to, the city's comprehensive development plan.
It does not conflict with any city, county, or regional plans, including the Comprehensive Plan.
3. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding and drainage are suitable for the type and density of development and uses contemplated.
The site is suitable for the existing and proposed residential uses.
4. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control
and all other services, facilities and improvements otherwise required in this article.
The proposed subdivision makes adequate provision for these items. Additional permits required to
comply with erosion control standards are required and will be secured prior to building permit issuance.
5. The proposed subdivision will not cause substantial environmental damage.
While trees may be removed, the subdivision will not cause substantial environmental damage.
6. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court

Most of the surrounding properties are developed as large lot homes and the St. Louis Park Sportsman
Club is south and west of the subject parcel. The proposed subdivision will not impact reasonable
development of neighboring land.
S. The proposed subdivision is notpremature. A subdivision is premature if any of the following exists:
a. Lack of adequate stormwater drainage.
b. Lack of adequate roads.
c. Lack of adequate sanitary sewer systems.
d. Lack of adequate off -site public improvements or support systems.
The subdivision is not premature as the above conditions have been provided for.

A Resolution of the City Council of the City of Elk River Granting Final Plat
Approval for TRIE Addition, Case No. P 20-12
WHEREAS, application has been made for final plat approval, pursuant to Section 30-391
of the Elk River City Code of Ordinances, of the property legally described on attached
Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the proposed final plat complies with each of the conditions set forth by the
City Council in its approval of the plat of the Property;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows:
A. The proposed subdivision is consistent with the Chapter of 30 of the City
Code of Ordinances and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including, but not limited to, the
City's Comprehensive Plan.
C. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and siltation,
susceptibility to flooding, and drainage are suitable for the type and density
of development and uses contemplated.
D. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services,
facilities and improvements otherwise required herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property.
The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
This final plat approval shall expire two years from the date of this resolution if the
final plat is not recorded within that time.

EXHIBIT A
LEGAL DESCRIPTION
That part of the East Half of the Southwest Quarter of Section 17, Township 33, Range 26,
lying Westerly of the center line of County State Aid Highway No. 1, as presently located
and established, Sherburne County, Minnesota.
EXCEPT That part of the Southeast Quarter of said Southwest Quarter of Section 17,
Township 33, Range 26, Sherburne County, Minnesota, lying Southwesterly of the center
line of County State Aid Highway No. 1 and lying north of the south 774.00 feet thereof.
And except that part of said Southeast Quarter of the Southwest Quarter lying west of said
Highway right of way and lying southerly of a line described as follows: Commencing at the
southwest corner of the North 79.55 feet of the South 250.00 feet of said Southeast Quarter
of the Southwest Quarter; thence North 0 degrees 26 minutes 26 seconds West along the
West line of said Southeast Quarter of the Southwest Quarter for a distance of 290.67 feet to
the actual Point of Beginning of the line to be hereby described; thence South 69 degrees 48
