Action Requested

Background/Discussion
The Windsor Park 3' Addition Homeowners Association (HOA) has a shared use, low pressure sewer system
with a failing treatment system. A feasibility report was completed and found the 88 homes in the HOA could
connect to the city system by running a new sewer line along Ranch Road from their existing shared drainage field
to the force main currently being constructed along the Great Northern Trail.
This public hearing on the improvement is the first hearing required following the MS 429 special assessment
process. In order to obtain accurate pricing to base the final assessments and follow the MS 429 process, the
plans and specifications need to be approved and ordered to be advertised for no less than 21 days to receive
competitive bids. A final assessment hearing would then be held based on the actual bid prices received.
The following is the current project schedule:
- October 5, 2020 — Receive Bids, Call for Assessment Hearing
- November 2, 2020 — Hold Assessment Hearing, determine if project will be awarded
Financial Impact
There are no financial impacts associated with this item. All project costs will be rolled into the assessments.

A Resolution of the City Council of the City of Elk River Authorizing the
Improvement of the Windsor Park 3"d Addition Sewer Extension Project
WHEREAS, pursuant to Resolution 20-45 of the City Council adopted August 3, 2020,
fixed adate for a public hearing on the improvement of the Windsor Park 3rd Addition Sewer
Extension project. The improvements shall consist of a sanitary sewer extension from the
Great Northern Trail to the Windsor Park 3' Addition along Ranch Road. The improvement
shall include gravity sanitary sewer, a lift station, and forcemain construction, and
WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was
given, and the hearing was held thereon on the 8th day of September, 2020, at which all persons
desiring to be heard were given an opportunity to be heard thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows:
1. Such improvement is necessary, cost-effective, and feasible as detailed in the feasibility
report.
2. Such improvement is hereby ordered as proposed.

A Resolution of the City Council of the City of Elk River Approving Plans and
Ordering Advertisement for bids for the Windsor Park 3"d Addition Sewer
Extension Project
WHEREAS, pursuant to Resolution 20-46 passed by the Council, Bolton & Menk, Inc. has
prepared plans and specifications for the Windsor Park 3' Addition Sewer Extension Project.
The improvement shall consist of a gravity sanitary sewer, a lift station, and forcemain
construction from the Great Northern Trail to the Windsor Park 3' Addition along Ranch
Road.
WHEREAS, in order to obtain competitive bid pricing to base the final special assessment
amounts, the project documents shall be advertised for no less than 21 days where they will be
publicly read.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota, as follows:
1. Such plans and specifications, copies of which are on file in the City Offices, are hereby
approved.
2. Bolton & Menk, Inc. shall prepare and cause to be inserted in the official paper and on
QuestCDN an advertisement for bids upon the making of such improvement under such
approved plans and specifications. The advertisement shall be published for no less than
21 days, shall specify the work to be done, shall state that bids will be received on
QuestCDN until 10:00 am on October 5, 2020 at which time they will be publicly opened
and read by the Project Manager. The bids will then be tabulated, and will be considered
by the council at approximately 7:00 p.m. on November 2, 2020, in the Council
Chambers of the City Hall. Any bidder whose responsibility is questioned during
consideration of the bid will be given an opportunity to address the Council on the issue
of responsibility. No bids will be considered unless submitted on QuestCDN and include
a bid bond payable to the City of Elk River for five percent (5%) of the amount of such
bid.
