Background/Discussion Mayor Dietz received an inquiry from a resident seeking to establish a home-based business selling and repairing firearms. Zoning ordinances currently prohibit firearm sales as a home occupation, either permitted or conditional. The specific sections of the ordinance are as follows: Sec. 30-801. - Home occupations. (a) Purpose. The purpose of this section is to provide a means, through the establishment of specific standards and procedures, by which home occupations can be conducted in residential neighborhoods, within a dwelling unit, without jeopardizing the residential character or health, safety and general welfare of the surrounding neighborhood. In addition, this section is intended to provide a mechanism enabling a distinction between permitted home occupations and conditional home occupations, so that permitted home occupations may be allowed through an administrative process rather than a quasi- judicial hearing process. (b) Prohibited activities. No home occupations (permitted or conditional) shall: (5) Involve any of the following: body shops, machine shops, ammunition manufacturing, flea markets, motor vehicle repairs within the Urban Service District, motor vehicle sales, escort businesses, sexually oriented land uses, gun repair and/or sales, or other objectionable uses as determined by the city council. Getting commercial space as a new business owner is not an easy task especially affording the business space and establishing customers. I am wondering if it is a possiblity to request a city council board meeting or hearing on this subject matter. As i am a law abiding citizen who sinply wants to start a business to provide for myself and my family and future generations to come. This business if allowed in my residence would not involve any flammable or explosive material as i do not plan on manufacturing any ammunition. I beleive the ability to sell and or repair firearms is a very important business to our country and our community, i beleive this is important because we have the right to bear arms and also protect our families.
