Background/Discussion The residential parcel at 9754 Viking Boulevard NW sold earlier this year. The property has been zoned R-1a Single-family Residential or agricultural since annexation. The owner intended to operate as a two-family (duplex) rental which city ordinances prohibit. The owner stated that she spoke with Elk River Municipal Utilities prior to purchase to verify the presence of two utility meters and noted inspection stickers on the electrical panel. She interpreted this to mean the property was approved by the city to operate as a duplex. Unfortunately, neither constitute approval of a duplex by the zoning authority or the city. The Sherburne County Assessor's Office classifies the property as a single-family use as far back as their records indicate. The building permit history also shows permit applications identifying the parcel as single-family. Options to meet the owner's desire are an Interim Use Permit to allow the use on a temporary basis or a zone change to R-2a, which supports two-family units (duplex). The city has previously approved both options for parcels within the urban service district. However, this lot is not served by city utilities, does not serve as a transition to high density housing and is surrounded by large lot residential uses. The owner would like the Council to consider classifying the home as a legal non -conforming use, which would allow her to use the building as a duplex without going through additional review. We want some kind of action done with the situation. We have provided you with pictures of different things that we believe are unsafe. You stated in our last conversation that because we have an eviction hearing that you don't want to proceed with this until you know whether we have to move or not. We believe that should not have any bearing an this situation. This residence needs to be repaired before someone gets hurt, after all there are children living in the lower unit of this residence. Some of the situations that need to be dealt with are as follows: 1. The electrical outlets that are not installed correctly 2. The light at top of stairs where wiring is hanging down 3. Pipes from shower leaking on electrical and into lower unit (landlord placed a towel to soak up any water that leaks) 4. Rear door that does not latch or lock properly 5. Tree growing under foundation by front door 6. Stairs to back door (not stable) 7. Hot water heater (strong odor) 8. Floor in front entrance (spongy and unsafe) 9. Front outside stairs (separating from foundation due to tree) 10. Fire barriers (per your information) 11. No insulation around windows 12. It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish, equip, use, occupy, § 30-155 or maintain any building or structure, or cause or permit such acts to be done, in violation of this article. (b) All buildings and structures and all parts thereof shall be maintained in a safe and sanitary condition. The owner or his designated agent shall be responsible for such maintenance. (c) Every owner, or his agent, in addition to being responsible for maintaining his building in a sound structural condition, shall be responsible for keeping that part of the building or premises which he occupies or controls in a clean, sanitary, and safe condition, including the shared or public areas in a building containing two or more dwell- ing units. (d) Every owner shall, where required by this article or the fire chief, furnish and maintain such approved sanitary facilities as required, and shall furnish and maintain approved devices, equip- ment or facilities for the prevention of insect and rodent infestation, and where infestation has taken place shall be responsible for the extermination of any insects, rodents, or other pests when such extermination is not specifically made the respon- sibility of the occupant by law or ruling. Every owner of a multifamily dwelling shall supply facilities for the storage and/or disposal of rubbish and garbage.
