DRAFT PC MINUTES 09-22-2020 WA City of Elk Meeting of the River Elk River Planning Commission Held at Elk River City Hall Tuesday, August 24, 2020 Members Present: Chair Jill Larson-Vito, Commissioners Perry Beise,Eric Johnson, John Jordan, Robert Rydberg, and Brad Thiel Members Absent: Commissioner Alexander Feinstein Staff Present: Senior Planner Chris Leeseberg and Sr. Admin. Assistant/Recording Secretary Jennifer Green I. Call Meeting to Order A:0 Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at 7:01 p.m. by Chair Larson-Vito. 2. Consider August 25, 2020, Planning Commission Agenda Moved by Commissioner Thiel and seconded by Commissioner Beise to approve the August 25, 2020, Planning Commission agenda. Motion carried 6-0- 0. 4b V 3. Consider July 28, 2020, Planning Commission Minutes Moved by Commissioner Thiel and seconded by Commissioner Beise to approve the July 28, 2020, Planning Commission minutes. Motion carried 6-0. ARA 4.1. Aegir Brewing Co. LLC — 19050 Industrial Blvd. NW ■ Conditional Use Permit to operate a Tap Room and Continue Brewery Operations, Case No. CU 20-15 Mr. Carlton"presented the staff report. Chair Larson-Vito opened the public hearing. Tim Jones and Jeremy Jones, the applicants,were available to answer questions. Chair Larson-Vito asked if they had any questions or concerns about the conditions. Jeremy Jones stated their biggest issue is parking and requested consideration for parking on the street to count toward their overall parking requirements. He stated he does not see anyone currently parking on the street as the building is in an Planning Commission Page 2 August 24,2020 ----------------------------- industrial development. He noted their business would have the highest patrons in the evenings when the surrounding businesses would not be open. Tim stated for the brewing portion of the business, 6 parking stalls are required, and he is the only brewer. He stated he understands the parking requirements are based on square footage but asked if a parking variance could be considered. Jeremy noted the grounds layout and stated they would eventually be taking over the entire 9,000 sq. ft. building when the current tenants'leases are due. He explained the grounds layout with a future dog park area and patio,which would be all connected and contiguous to comply with the state's alcohol requirements. He stated they are open to suggestions with site layout to comply with city requirements. Commissioner Thiel stated parking is always an issue and he personally is a stickler for ensuring the parking requirement ratios are met for current and future uses. Commissioner Johnson asked how many barrels is being brewed as ordinance limits the number of barrels to 20,000 barrels annually. The applicants stated they have brewed approximately 364 barrels this year. Commissioner Johnson asked for more information about the requirements for parking and stated going from 32 to 69 parking spots is a big jump in the number of parking spots. The Planning Commission discussed the options for adding additional parking stalls and the applicants stated they were open to making it work while they continue s expanding into the entire building. here being no one else to speak, Chair Larson-Vito closed the public hearing. g P P g Chair Larson-Vito asked for clarification that if the applicant wants to request a change and vary number of parking spots,would they then have to go through the variance application process. Mr. Leeseberg stated that was correct. Commissioner Beise asked if all the parking spots had to be in place before they opened the business. Mr. Leeseberg stated technically yes, before construction of the facility the conditions must be met and the conditional use permit filed with Sherburne County, but the applicant has two years to complete those conditions before operating their business. it-401 wEeEUo0IE 1YAR' Planning Commission Page 3 August 24,2020 ----------------------------- Commissioner Johnson stated it sounded like the applicants were open to accommodating what the ordinance requires and felt they could get created on how they would use the site over time and while expanding, but wanted to ensure they weren't impeded by the requirements and were able to grow into their plans. Moved by Commissioner Johnson and seconded by Commissioner Rydberg to recommend approval of the Conditional Use Permit to operate a tap room and continue brewery operations at 19050 Industrial Blvd. with the following conditions: 1. The Conditional Use Permit shall not be recorded until the city building official and fire marshal have inspected, and approved, the building for compliance with all state and local building codes. 2. No more than 20,000 barrels of its own brands of malt liquor may be brewed annually. 3. A minimum of 69 parking stall shall be provided on the subject property. 4. A single outdoor patio location exhibit shall be submitted and approved by city staff. 5. The outdoor patio area shall be delineated with a permanent fence. 6. Expansion of the tap room and/or the microbrewery will require an amendment to the Conditional Use Permit. Motion carried 6-0. S.
