09-04-1956 VCM VILLAGE OF ELK RIVER COUNCIL MEETING September 4, 1956 The regular meeting of the Elk River Village Council was called to order by Mayor Schwartz on September 4, 1956. All members were present. The minutes of the last meeting were read and approved. Mr. Dewey Mattson, Asst. Dist. Engineer of the State Highway Department was present in regard to getting approved of work to be done on a section of Highway No. 10 in the Village. Also agreement with Village not to allow any encroachment upon right of way of Highway No. 10 in the Village. Resolution to this effect were proposed by Dan Bailey and seconded by August Meyer. Upon being put to a roll call vote the resolution passed all members voting in favor. Copier of these resolutions on forms 2522 and 2523 are on file with the Village Clerk. A delegation representing the Surf Aces with Morris Wilson as spokesman were present at the meeting. They about regulations regarding motor boats and water skiing on the lake on the Wexler property now belonging to the Village. The Council made it know there would no doubt be a swimming beach on the property but that nothing would be done to interfere with the boating and skiing any more than necessary. Marshall Oliver Nickerson reported that he has trouble with teenagers driving cars in the Village and that too many are driving cars to school. A motion was made by Dow and seconded by Briggs to allow the State permission to use grant St. as a detour while repairing R.R. Crossing on Highway 169. Carried. A motion was made by Bailey and seconded by Dow to trade the old truck for a 1952 tractor and pay the difference of $475.00. Motion carried. A motion was made by Bailey and seconded by Meyer to Authorize Lester Derr to have a power lift put on the new truck. Carried. Briggs Village Clerk Form 2523 Resolution th At a regular meeting of the Village Council of the Village of Elk River duly held on the 4 day of September, 1956, the following Resolution was offered by Dan Bailey, seconded by August Mayer, to-wit: WHERAS, the Commissioner of Highways has prepared plans and specifications for the improvement of a part of Trunk Highway No. 3 renumbered as Trunk Highway Number 10 within the corporate limits of the Village of Elk River from the Depot Avenue to south corporate limits; and WHEREAS, said plans are on file in the office of the Department of Highways, Saint Paul, Minnesota, being marked, labeled, and identified as State Proj. No. 7101-28 (T.H. 10-3) and WHERAS, said specifications are on file in the office of the Department of Highways, Saint Paul, Minnesota, being marked, labeled, and identified as State Proj. No. 7101-28 (T.H. 10-3), which, together with the Minnesota Department of Highways Specifications for Highway Construction, dated July 1, 1947, and Supplement No. 1 to the Minnesota Department of Highways Specifications for Highway Construction, effective April 15, 1953, on file in the office of the Commissioner of Highways, constitute the specifications for said improvement of Trunk Highway Number 3 renumbered as Trunk Highway Number 10; and WHEREAS copies of said plans and specifications as so marked, labeled, and identified are also on file in the office of the Village Clerk; and WHEREAS the term “said plans and specifications” as hereinafter used in the body of this resolution shall be deemed and intended to mean, refer to, and incorporate the plans and specifications as in the foregoing recitals particularly identified and described. NOW, THEN, BE IT RESOLVED that said plans and specifications for the improvement of Trunk Highway Number 3 renumbered as Trunk Highway Number 10 within the limits of the Village of Elk River be and hereby are approved. BE IT FURTHER RESOLVED that the elevations and grades as shown in said plans and specifications be and they are hereby approved and consent is hereby given to any and all changes in grade occasioned by the construction of said Trunk Highway Number 3 renumbered as Trunk Highway Number 10 in accordance with said plans and specifications. Upon the call of the roll the following Trustees voted in favor of the Resolution: Dan Bailey, August Mayer, Harry Dow, H.A. Briggs. The following voted against its adoption: none. WHEREUPON the Mayor and presiding officer declared the Resolution adopted. Briggs, Clerk Form 2522 S.P. 7101-28 (10-3) Resolution th At a regular meeting of the Village Council of the Village of Elk River duly held on the 4 day of September, 1956, the following Resolution was offered by Dan Bailey, seconded by August Mayer, to-wit: WHERAS, the Village of Elk River has approved the plans and specifications for the improvement of that part of Trunk Highway Number 3 renumbered as Trunk Highway Number 10 within the corporate limits of the Village of Elk River from Depot Avenue to south corp. limits; and WHERAS, in order to obtain Federal aid in the construction of said Trunk Highways Number 3 renumbered as Trunk Highway Number 10 the Bureau of Public Roads requires the assurance that the Village of Elk River will not suffer any encroachment of any nature or kind whatsoever on the right of way of said Trunk Highway Number 3 renumbered as Trunk Highway Number 10 within the corporate limits of the said Village of Elk River; and WHERAS, the Commissioner of Highways desires in the interest of public safety that all parking of vehicles on said trunk highway be parallel with the curb and at least 20 feet from any crosswalk. NOW, THEN, BE IT RESOLVED that said Village of Elk River does hereby agree and covenant that it will never permit or suffer, within its corporate limits, any encroachment of any kind whatsoever, including curb gas pumps and gas stations, billboards or other structures of any kind whatsoever, upon the right of way of Trunk Highway Number 3 renumbered as Trunk Highway Number 10 and to the above end said Village of Elk River hereby agrees that it will never issue any license, permit, or grant, or give any leave or liberty or any other consent of whatever form for the construction or maintenance of any encroachment whatsoever, including curb gas pumps and gas stations, billboards or other structures of any kind whatsoever, upon said right of way; and that said Village of Elk River will cooperate insofar as possible to eliminate existing encroachments constituting traffic hazards and will further take any necessary action to eliminate any encroachment that may hereafter exist on said trunk highway right of way; and BE IT FURTHER RESOLVED that said Village of Elk River does hereby agree to require the parking of all vehicles on said trunk highway to be parallel with the curb and at least twenty (20) feet from any crosswalks on all public streets intersecting said trunk highway within the corporate limits of said Village of Elk River. Upon the call of the roll the following Trustees voted in favor of the Resolution: Dan Bailey, August Mayer, Harry Dow, H.A. Briggs, Clerk NOTICE OF SPECIAL ELECTION NOTICE IS HEREBY GIVEN that a special village election will be held in and for the Village of th Elk River, Sherburne County, Minnesota on Tuesday the 30 day of July 1957 between the hours of 4:00 o’clock P.M. and 8:00 o’clock P.M. at which the following proposition will be submitted to the voters of the Village: Shall the Village of Elk River, Minnesota, issue its negotiable coupon general obligation bonds in an amount not exceeding $120,000, for the purpose of constructing and equipping a new municipal building? The polling place for said election will be at the Municipal Building in the Village Dated July 1, 1957. BY ORDER OF THE VILLAGE COUNCIL H.A. Briggs Village Clerk Village of Elk River, Sherburne County, Minnesota 4. The Village Clerk is hereby authorized and directed to cause official ballots to be prepared. Said ballots shall be distributed to the election officials at the polling place for use at said election. They shall be printed in black ink on lavender paper, if such color paper is obtainable, and the face thereof shall read as follows: OFFICIAL BALLOT SPECIAL ELECTION VILLAGE OF ELK RIVER, MINNESOTA JULY 30, 1957 Shall the Village of Elk River, Minnesota, issue its negotiable coupon general obligation bonds in an amount not exceeding $120,000, for the purpose of constructing and equipping a new municipal building? YES NO INSTRUCTIONS TO VOTERS: If you wish to vote in favor of the above proposition, mark a cross (x) in the square opposite the word YES. If you wish to vote against said proposition, mark a cross (x) in the square opposite the word NO. On the back of each ballot there shall be printed the words “OFFICIAL BOND BALLOT”, the date of election, the facsimile signature of the Village Clerk, and lines for the initial of two judges. 5. The Village Clerk shall also provide the election officials with suitable tally sheets, poll lists, form of official returns, ballot boxes, and other necessary supplies for the conduct of said election.
