VILLAGE OF ELK RIVER COUNCIL MEETING
July 1, 1957
The regular meeting of the Village Council of the Village of Elk River was called to order on July 1,
at the Municipal building by Mayor Schwartz. All members were present. The minutes of the last
meeting were read and approved.
Russell Oliver was present in regard to developing certain street on some of his lots. There was
discussion with the village attorney Mac Gibbon, but no further action was taken.
A petition was presented by property owners in west part of village asking for sewer extension. For
the reason that the petition does not show names of streets nor just where proposed sewer is to be
located no further action was taken at this meeting.
Pat Kilmartin was present. He asked about extending his sidewalk to the Bernard property and
making proper grade as his sidewalk grade is much lower than the Bernard property. The matter was
left to the Road and Bridge Committee.
A motion was made by Dow and seconded by Meyer to allow George Maas two weeks’ vacation at
average rate of pay. Motion carried.
A delegation representing the athletic assn. with Jack Hetrick as spokesman met with council. They
want permission to deed certain land owned by them to the County Fair Board.
A motion was made by Briggs and seconded by Sandberg to deed this land to the Fair Board with
certain stipulations proposed by the village attorney. Motion carried.

RESOLUTION
The Village Council of the Village of Elk River, County of Sherburne, State of Minnesota, being in

regular session on the 1 day of July, 1957, all members being present, Councilman Fred Sandberg
offered the following resolution and moved its adoption:
That whereas the Village of Elk River holds in trust for use as a municipal park, athletic field and for
other public uses not consistent with said uses the following described premises situated in the
County of Sherburne and State of Minnesota, to-wit:
All that part of the West Half of the Northeast Quarter of the Southwest Quarter (W ½ of NE ¼ of
SW ¼), of Section Thirty-two (32), Township Thirty-three (33), Range Twenty-six (26), lying South
of Old Highway No. 10, (formerly known as the Elk River-Big Lake Road) except that portion
described as follows: Beginning at the intersection of the East line of said W ½ or NE ¼ of SW ¼
and the center line of old U.S. Highway No. 16; thence South on said East line a distance of 650
feet; thence West parallel with the North line of said W ½ of NE ¼ of SW ¼ to a point 150 feet
east of the west line of said W ½ of NE ¼ of SW ¼; thence North parallel with the west line of said
W ½ of NE ¼ of SW ¼ to the center line of old U.S. Highway No. 10; thence Southeasterly along
the center line of said highway to the point of beginning and
Whereas said land is not needed for any village purpose; and
Whereas the Sherburne County Agricultural Society desires to acquire said premises to be used as a
county fair grounds; and
Whereas The Elk River Athletic Association, a non-profit corporation, having a reversionary interest
in said premises has agreed to release said right to said agricultural society, so long as said premises
shall be used for purposes relating to the operation and conducting of a county fair, or any other
purposes incidental to or consonant with the activity of an agricultural society. It is the intention of
the parties hereto that the provisions of this paragraph shall never act or operate to cut off or
terminate the rights of a bona-fide mortgage of said premises, nor shall such provision limit or
restrict the secondary use of the said premises by the party of the second part for income producing
purposes, if such income is necessary or essential to the operation of a county fair ; provided that
said premises shall not become primary commercial in character, nor shall any loud, noxious, or
immoral activity be permitted upon said premises under any circumstances.
IT IS HEREBY RESOLVED, by the Village Council of the Village of Elk River, Minnesota, that
the above described premises is not needed for any village purpose and that it is in the public
interest that said premises be conveyed to the Sherburne County Agricultural Society subject to the
provisions hereinbefore set forth, and
IT IS FURTHER RESOLVED, that the mayor and the village clerk be, and they hereby are,
authorized and directed to execute and deliver to said agricultural society a good and sufficient deed
of conveyance transferring to said society the interest of the village in said premises subject to the
provisions hereinbefore set forth.
This motion was seconded by Councilman Harry Dow and put to a vote, all members present voted
for it and it was thereby adopted.

Village of Elk River, Sherburne County, Minnesota
Held July 1, 1957
A regular meeting of the Village Council of the Village of Elk River, Minnesota, was held at the
Municipal Building in said Village on July 1, 1957, at 7:30 o’clock P.M.
The following members were present:
Edward C. Schwartz, Mayor; Harry Dow, Trustee; August Meyer, Trustee; Fred Sandberg, Trustee;
Harry Briggs, Clerk.
And the following were absent: None
Member Dow introduced the following resolution and moved its adoption:
RESOLUTION DETERMINING THE NECESSITY AND EXPEDIENCY OF ISSUING
MUNICIPAL BUILDING BONDS AND CALLING SPECIAL ELECTION TO VOTE ON
THEIR ISSUANCE
BE IT RESOLVED by the Village Council of the Village of Elk River, Minnesota as follows:
1. This Council deems it necessary and expedient that the Village should construct and equip a
new municipal building, and should provide funds necessary for said purpose by issuing its
negotiable coupon general obligation bonds in an amount not exceeding $120,000.
2. The proposition of issuing bonds, as set forth in the form of ballot prescribed below, shall
be submitted to the voters at a special election which is hereby called and directed to be held

in and for the Village on the 30 day of July, 1957, between the hours of 4:00 o’clock P.M.
and 8:00 o’clock P.M. Said election shall be held at Municipal Building in said Village, and
the following three persons are hereby appointed and shall act as judges of election: H.J.
Pfeiffer, Ruth Flaherty, and Mabel Greupner. They shall appoint two qualified voters of the
Village to act as clerks of election.
3. The Village Clerk is hereby authorized and directed to post notice of said special election at
said polling place and at least three other public and conspicuous places in the Village, at
least 10 days before the date of said election, and to publish notice of said election in the Elk
River Star News at least 7 days before said date, which notice shall be in substantially the
following form:
6. This Council shall meet within two days following the date of said election, to-wit: On July 31,
1957, at 7:30 o’clock P.M. at Municipal Building in said Village for the purpose of canvassing the
results of said election and declaring the result thereof, and for the purpose of transacting such other
business as may properly come before the meeting.

The motion for the adoption of the foregoing resolution was duly seconded by Member Sandberg,
and upon vote being taken thereon, the following voted in favor thereof:
Meyer, Sandberg, Dow, Briggs
And the following voted against the same: None
Whereupon said resolution was declared duly passes and adopted, and was signed by the Mayor,
which was attested by the Village Clerk.

I, the undersigned, being the duly qualified and acting Clerk of the Village of Elk River, hereby attest
and certify that
(1) As such officer, I have the legal custody of the original record from which the attached and
foregoing extract was transcribed;
(2) I have carefully compared and extract with said original record;
(3) I find said extract to be a true, correct and complete transcript from the original minutes of a
meeting of the Village Council of said Village held on the date indicated in said extract,
including any resolutions adopted at such meeting, insofar as they relate to $120,000
Municipal Building Bonds of the Village; and
(4) Said meeting was duly held, pursuant to call and notice thereof as required by law.
