VILLAGE OF ELK RIVER COUNCIL MEETING
April 6, 1959
The regular meeting of the Elk River Village Council was held at the Village Hall on April 6, 1959
with all members present. The meeting was called to order by Mayor Johnson. The minutes of the
last meeting were read and approved.
Members of the Fire Department were present. Fire contracts with outlying districts are to be
renewed each year. The Clerk was instructed by the Council to prepare new contracts with the
following towns: Elk River, Burns, Big Lake, Otsego, Ramsey and Livonia.
Trustee Kemper proposed the attached resolution regarding the site of the sewage disposal plant
and moved its adoption. It was seconded by Briggs and passed all voting in favor.
A petition was presented to the Council signed by 83 persons objecting to using the downtown park
for a parking lot. The petition was placed on file.
A motion was made by Bergerson and seconded by Kemper to buy the street signs from The
Gopher Stamp and Die Co. of Minneapolis at a price of $6.65 each. Mr. W. J. Pruit of that company
was present at the meeting. Motion carried.
A motion was made by Briggs and seconded by Meyer to buy two inch galvanized pipe for the sign
posts from Carlson Bros Hardware at 45 cent per foot. Carried.
The Council instructed the Clerk to write the Elk River Motor Sales demanding a new motor for
the Plymouth Police Car for the reason that the car is taking two much oil and has only about 3000
miles on it.
A motion was made by Meyer and seconded by Bergeson to authorize the Elk River Fire
Department to answer fire calls outside the village limits as well as in the villages. Carried.

RESOLUTION SELECTING SITE FOR SEWAGE DISPOSAL PLANT
WHEREAS a resolution has heretofore been adopted on the __ day of ___ 1958, authorizing a
preliminar survey relating to the construction of a sewage disposal plant, and
WHERAS, pursuant to said resolution the firm of Carter, Krueger and Associates, Inc. Consulting
Engineers were retained by this council to make said preliminary survey, including recommendations
as to the location of a site for the said sewage disposal plant, and
WHERAS, after receiving a report from the said firm of Carter, Kruegger & Associates that the
construction of such a plant was feasible, a recommended location or site for same, and an estimated
cost of construction for said plant, this council did make application to the United States of America
for federal aid in the construction of the plant as proposed and estimated, and
WHERAS, pursuant to said application for federal aid, this council was advised by the officials of
the department concerned of the United States that its application was accepted with a priority of
number on in the State of Minnesota, and a grant of approximately $49,000.00 was therefore
authorized to assist in the construction of said plant, and
WHEREAS, said preliminary survey, report and estimate determined that no other site was
acceptable from an engineering or economic point of view, than a tract, containing approximately
four (4) acres situated at the intersection of the Northern Pacific Ry. right-of-way with the North
line of Section Three (3), Township 32, Range 26, Sherburne County, Minnesota, and extending
approximately 700 feet east and 240 feet, south of said point of intersection, which tract is also
located in the vicinity of and northerly from the present plant sit of the Rural Cooperative Power
Association,
WHERAS, the Rural Cooperative Power Association has manifested an interest in acquiring the title
to such part of Government Lot 4, Section Three (3), Township 32, Range 26, not needed for said
sewage disposal plant, and
WHEREAS it has been determined those portions of said Government Lot 3 required by this
council for sewage disposal site and by the R.C.P.A. for plant purposes, are owned by the State of
Minnesota, having been acquired for highway purposes, and in particular for borrow pit usage, and
WHEREAS, this council has been advised that the former owner and his spouse of said portions of
Government Lot 3 are deceased, and that under existing statutes no method of conveyance of real
estate thus owned by the State of Minnesota is permissible except at public auction, after due
advertisement of such auction, which procedure would do irreparable harm to the Village of Elk
River by increasing the cost of the site to a price that would likely render the construction of the
proposed sewage disposal plant economically unfeasible because of the common knowledge that it is
the only available plant site,
NOW THEREFORE BE IT RESOLVED, That this council formally endorse, advocate and
promote special legislation now before the Minnesota State House of Representatives and Senate
authorizing the Commissioner of Highways of the Sate of Minnestoa to recommend the conveyance
of the aforedescribed property upon such terms and conditions and he may prescribe to the Village
of Elk River and the Rural Cooperative Power Association in such propotions as said Village, Rural
Cooperative Power Association, and Commissioner of Highways may agree, and,
BE IT FURTHER RESOLVED THAT The Village Clerk is authorized and directed to transmit
copies of this resolution to such representatives, senators, and other interested persons as may
require same or need same to further the said special legislation.
