RESOLUTION 90 - ~
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR REMOVING CERTAIN PROPERTY FROM THE
PLANNED URBAN SERVICE AREA
WHEREAS, a majority of the property owners within the affected
property have requested that the City Council remove
their property from the Planned Urban Service area;
and,
WHEREAS, a public hearing was held on September 25, 1990,
before the Planning Commission and on October 15,
1990, before the City Council at the Elk River Public
Library on a request to rezone the property from R-1C
single family to R-1A single family, as well as, to
remove the property from the Planned Urban Service
area after due published notice had been given, as
well as, personal notice to affected property owners
by the Clerk on September 15, 1990 and all persons
interested were given an opportunity to be heard; and,
WHEREAS, the R-1A zoning designation does not require that
property hook up to City sewer and water; and,
WHEREAS, it appears that removal of the affected property from
the Planned Urban Service area would not have a
detrimental affect on the extension of urban services
to adjacent properties.
NOW, THEREFORE, BE IT RESOLVED that said request is hereby
granted and the affected property described as follows
is hereby removed from the Planned Urban Service
area: See attached Exhibit A.
Adopted by the City Council of the City of Elk River this 15th
day of October, 1990.
