VILLAGE OF ELK RIVER COUNCIL MEETING
June 2, 1941
A regular meeting was held at the Municipal Bldg on June 2, 1941 at 8:00 P.M.
Members present:
M.C. Tesch, Pres; Frank Nickerson, E.L. Shadick, and G.A. Bailey, Trustees; J.
Clinton Walker, Clerk
The minutes of the previous meeting were read and approved.
The President announced that the meeting was convened for the purpose of considering objections
to the assessments therefore filed with the Village Clerk.
The Clerk reported that written objections had been filed by the following persons affecting the
following described lots, pieces or parcels of land, to wit:
D.A. Dare and Charles V Bressler filed written objections to extending sewer to Lot 5, Block 7 and
Lot 8, Block 8, W.H. Houlton’s addition stating that sewer should not extent in front of these lots
and D.A. Dare was heard in support of such objection.
The following persons were then heard and presented their objections to said assessments:
Henry La Montague appeared and was heard as to Lots 3, 4, 5 and 6, Block 8, W.H. Houlton’s
Addition, orally stating that the way his house was build he only gets benefits from frontage of two
lots.
Clifford Martineau appeared and was heard as to N. 100’ of Lots 8, 9 and 10, Block 4, Thomas
Addition, orally stating that he gets no benefits and that sewer runs too close to his house.
Truman W. McMillan appeared and was heard as to Lot 1, Block 9, Thomas Addition stating that he
was now served by private sewer.
After consideration of all of said objections, Trustee Shadick introduced the following resolution
and moved its adoption.
Resolution
A Resolution Confirming Assessments in Sewer District No. 1
Be it resolved by the Village Council of the Village of Elk River, Sherburne County, Minnesota as
follows:
1. The engineers heretofore duly selected by this Council for such purpose have, with the
assistance of the Village Clerk, calculated the proper amount to be specially assessd for the
construction of sewer in Sewer District No. 1 of said Village agains every assessable lot,
piece or parcel of land within said District in accordance with the provisions of law, and
have prepared and filed with the Village Clerk tabulated statements in duplicate showing the
proper description of each and every lot, piece or parcel of land to be specially assessed and
the amount calculated against the same.
2. Notice has been duly published so required by law that this Council would meet in regular
session at this time and place to pass on the proposed assessment.
3. Said proposed assessments have at all times since its filing been open to inspection and
copying by all persons interested and an opportunity has been given to all interested person
to present their objections, if any, to such proposed assessment, or to any item thereof, and
objections have been filed.
4. The assessments specified in the proposed assessments are changed and altered as follows:
No Changes or Alterations.
5. This Council finds that each of the lots, pieces or parcels of land enumerated in said
proposed assessment was and is specially benefited by the construction of said sewer in
Sewer District No. 1 in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land respectively, and that said amount so set out is herby
levied against each of the respective lots, pieces or parcels of land therein described.
6. Such proposed assessment is affirmed, adopted and confirmed and the sums fixed and ___
in said proposed assessments, with the changes of alterations herein above made, are
affirmed, adopted and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
7. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk
and filed in his office and shall thereupon be and constitute the special assessment the for
the construction of sewers in Sewer District No. 1.
8. The amount assessed against each lot, piece or parcel of land shall bear interest from the
date hereof until the same have been paid at the rate of three per cent per annum.
9. Such assessments shall be payable in ten equal annual installments payable on the ifrst day of
January in each year, beginning in the year 1942 and continuing until all of said installments
shall have been paid, each installment to be collected with taxes collectible during said year
by the County Auditors.
10. The Village Clerk is herby directed to make up and file in the office of the County Auditor
of Sherburne County a certified statement of the amount of all of such statement of the

amount and the amount which will be due thereon the 1 day of January in each year.

The motion for the adoption of the foregoing resolution was duly seconded by Trustee Nickerson,
and upon vote being taken thereon the following voted Aye: E.L. Shadick, Frank Nickerson, G.A.
Bailey, J. Clinton Walker, M.C. Tesch and the following voted nay: None. Whereupon said
resolution was declared duly passed and adopted and the President of the village Council being
present affixed his signature thereto in approval thereof.
John Humbolt was heard regarding the storm water situation at his place stating that water from the
street runs down on to his garden and asked that the grade be established on the road which runs
past his place between Main and Depot Streets. After some discussion the problem was referred to
the road committee.
Chester Waite Jr. said that his girl needed her adenoids and tonsils removed and asked for a food
stamp book. He was allowed the operation for his girl and a $12.00 food stamp book.
A motion was made by Frank Nickerson that all funds of the Village be carried in the First National
Bank, with the exception of the Liquor fund and Sewer funds which will be carried in the Bank of

Elk River, from the 1 day of January 1941 until further action is taken: Motion was seconded by
E.L. Shadick and carried.
It was decided to have the sidewalk west of the Elk River bridge finished as far as the swimming
pool.
A motion was made by Frank Nickerson to hire Irvin Moldenhauer as life guard for three months at
$50.00 a month. The motion was seconded by G.A. Bailey and carried.
A motion was made by Frank Nickerson to send three Firemen to the Fireman Convention and give
them $10.00 each for expenses. The motion was seconded by G.A. Bailey and carried.
A motion was made by G.A. Bailey to purchase four signs advertising the Municipal Liquor Store
from Danielson Sign Co. for $99.95. The motion was seconded by E.L. Shadick and carried.
A motion was made by E.L. Shadick and seconded by Frank Nickerson granting Arthur Leger, Off

and On sale beer licenses and license for two pin ball machines due the 12 of June. Motion was
seconded by Frank Nickerson and carried.
