RESOLUTION 90 - ~
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RELATING TO THE SETTING OF THE CITY
LANDFILL FEE PURSUANT TO SECTION 605.08 (3) OF THE
ELK RIVER CITY CODE
WHEREAS, the City of Elk River has the authority to set a
Landfill tipping fee pursuant to Minnesota Statutes
Section 1158.921i and,
WHEREAS, the City of Elk River had previously established the
Landfill tipping fee at $1.00 per cubic yardi and,
WHEREAS, the Elk River Landfill (ERL) appeared before the Elk
River City Council on July 23, 1990, and September 17,
1990, and requested a temporary reduction in the
Landfill fee to enable the ongoing economic vitality
of ERLi and,
WHEREAS, the City Council deemed it to be in the pUblic
interest to ensure that ERL continue to meet its
financial and environmental obligationsi and,
WHEREAS, in City Resolution 90-30 and Resolution 90-48, the
City temporarily reduced a solid waste tipping fee to
.50~ per cubic yardi and
WHEREAS, the City Council now deems that it is appropriate to
reinstate the previously established Landfill tipping
fee at the $1.00 per cubic yard rate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River that the solid waste tipping fee be
established at $1.00 per cubic yard to be collected
from ERL, effective upon adoption of this resolution.
Passed and adopted by the Elk River City Council this 15th day
of October, 1990.
