VILLAGE OF ELK RIVER COUNCIL MEETING
July 5, 1944
Regular meeting of the Elk River Village Council was held in the Municipal building on July 5, 1944.
All members were present.
R.W. Richardson, engineer met with the Council regarding bill for professional services rendered.
A committee composed of Richard Halter, August Meyers and Bert Nelson met with the Council
regarding recent flood in territory north of tracks and asked that something be done. The matter was
taken under advisement by the Council.
A motion was made by Kramer and seconded by Bailey that bill of R.W. Richardson be allowed.
Motion Carried.
William Roggatz, Village Fire Chief attended the meeting and asked to be allowed to purchase 400
ft. of hose for Fire Department. The purchase was approved.
The Council ordered the Clerk to publish notice in the Star News that all trees must be trimmed so
as to be not less than seven feet above the sidewalk.
E.L. Shadick asked that the Village appropriate funds to help pay for mileage for price clerk in
connection with the County Ration office. It was moved by Leger and seconded by Bailey that the
Village appropriate not more than $10.00 a month for this purpose. Motion Carried.
The matter of an on sale liquor store for Elk River was brought up for discussion and the following
resolution was presented by Elmer Leger and seconded by John Kramer.
Ordinance No. 39A
An ordinance amending Section 1 and Section 4 and Section 5 of Ordinance No. 39 Entitled “An
Ordinance Establishing a Municipal Liquor Dispensary” Passed July 5, 1944
The Council of the Village of Elk River do ordain as follows:
Section 1: Section 1 of ordinance No. 39 entitled “An Ordinance Establishing a Municipal
Dispensary” is amended to read as follows:
“A Municipal liquor dispensary is hereby established to be operated within this municipality for the
sale of liquor potable as a beverage and containing more then 3.2% of alcohol by weight. Both for
consumption at such dispensary and on such premises by the drink and in the sealed or closed
receptacle or container for removal from the premises. No person shall sell, barter or otherwise
dispose of intoxicating liquor, nor shall a sale be made by anyone outside of said dispensary or by
anyone not employed by said dispensary. It shall be unlawful for any person or persons to mix or
prepare liquor for consumption any public place of business or to consume liquor in such places
outside of the dispensary. No liquor shall be sold or consumed on a public highway or in an
automobile.”
Section 2.: Section of the ordinance referred to in Section 1 is hereby amended to read as follows:
“The municipal dispensary shall at all times observe the following restrictions upon the hours of
operation: no sale of intoxicating liquor shall be made on Sunday nor before three o’clock p.m. on
any memorial day nor before right o’clock p.m. on any election day in the Village. No “on sale” shall
be made before eight o’clock a.m. or after twelve o’clock midnight of any day. No “off sale” shall be
made before eight o’clock a.m. or after eight o’clock p.m. of any day except Saturday, on which “off
sale” may be made until ten o’clock p.m; provided, that no “off sale” may be made on New Year’s
Day, January 1; Memorial Day, May 30; Independence Day, July 4; Thanksgiving Day, or Christmas
Day, December 25; but on the evening preceding such day, if the sale of liquor is not otherwise
prohibited on such evenings, “off sale” may be made until then o’clock p.m. except that no “off
sale” shall be made on December 24 after eight o’clock p.m.”
Section 3. Section 5 of the ordinance referred to in Section 1 is hereby amended to read as follows:
“(a) No food or billiard table shall be kept in the dispensary or any rooms connecting therewith; nor
shall any one on such premises keep, possess or operated on such premises or in any rooms
adjoining or connected therewith any slot machine, dice or any other gambling device or permit the
same to be kept or used. No gambling shall be permitted on such premises, nor shall any person of a
know immoral character or any disorderly person be permitted on such premises.”
“(b) No other business than the sale of liquors shall be carried on by the dispensary or by any person
employed therein during the time so employed and in conjunction therewith, except that cigars,
cigarettes, snuff, tobacco and soft drinks may be sold both “on sale” and “off sale” during the hours
the dispensary is open for the sale of intoxicating liquor.”
“(c) No liquor shall be sold either for consumption upon the premises or for removal therefrom to a
person who is an intoxicated condition.”
“(d) No liquor shall be sold to a minor.”
“(e) No person shall be permitted to loaf or loiter about the dispensary habitually.”
“(f) No premises shall be leased for a dispensary upon which taxes, assessments or other legal public
levies are delinquent and unpaid.”
Section 4: This ordinance shall take effect and be in force from the date of its publication. Passed by
