RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR ADDING CERTAIN PROPERTY
TO THE PLANNED URBAN SERVICE AREA
WHEREAS, the property owner within the affected property has
requested that the City Council add the affected
property to the Planned Urban Service area; and,
WHEREAS, the City Engineer has reviewed the request and
determined that the City does have the capacity to
service this area; and,
WHEREAS, a public hearing was held on October 23, 1990, before
the Planning Commission and on November 19, 1990, and
November 26, 1990, before the City Council at the Elk
River Public Library on a request to rezone the
property from R-1c, single family and R-2b, townhouse
and multiple family to R-3, townhouse and multiple
family, as well as add the affected property to the
planned urban service area after due published notice
had been given as well as personal notices to affected
property owners by the Clerk on October 12, 1990, and
all persons interested were given an opportunity to be
heard; and,
4It WHEREAS, it was the recommendation of the Planning Commission,
and was adopted by Ordinance Amendment 90-47 to the
City's Zoning Map by the City Council, to rezone the
affected property from R-1c and R-2b to PUD; and,
WHEREAS, the underlying land use of HR, high density
residential, was deemed appropriate for the affected
property by the City Council; and,
WHEREAS, the HR land use designation would require the property
to hook up to City sewer and water.
NOW, THEREFORE, BE IT RESOLVED that said request is hereby
granted and the affected property described as follows
is hereby added to the Planned Urban Service area:
