88-030 RES . WHEREAS, WHEREAS, WHEREAS, WHEREAS, RESOLUTION 88- 30 A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION FOR VACATING RIGHT-OF-WAY a majority of the property owners abutting the right- of~way have requested the City Council in a petition dated May 20, 1981, to vacate such right-of-way according to law; and, a public hearing was held on 4/18/88 before the City Council at the Elk River Public Library on such petition after due published and posted notice had been given, as well as personal notice to affected property owners by the clerk on 4/8/88 and all persons interested were given an opportunity to be heard; and, that portin of the right-of-way is no longer used or maintained by the City, and; it appears that it will be in the best interest of the pub- lic to approve such petition; NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby granted and the right-of-way described as follows is hereby vacated: That portion of 193rd Avenue N.W. described as lying 33 feet on each side of the following described line: Beginning at a point on the North line of the Southwest Quarter of Section 28, Township 33, Range 26, Sherburne County, Minnesota where said line intersects a line 66.00 feet Southwesterly of, as measured at right angles to, the Westerly line of the right-of-way of the Burlington Northern (formerly Great Northern) railroad; thence West along said North line of the Southwest Quarter to the Northwest corner of said Southwest Quarter of Section 28; thence West along the North line of the Southeast Quarter of Section 29, said Township 33, Range 26 to intersect with and terminate at the Easterly line of the right-of-way of C.S.A.H.
