Call Meeting to Order Pursuant to due call and notice thereof, the meeting of the Elk River Planning Commission was called to order at7:07 p.m. by Chait Larson-Vito. 2. Consider August 25,2020, Planning Commission Agenda Moved by Commissioner Thiel and seconded by Commissioner Beise to approve the August25,2020, Planning Commission agenda. Motion carded 6-0. 3. Consider July 28, 2020, Planning Commission Minutes Moved by Commissionet Thiel and seconded by Commissioner Beise to approve the Juty 28,2020, Planning Commission minutes. Motion carded 6-0. 4.a. Aegir Brewing Co. LLC - 19050 lndustrial BIvd. NW ' Conditional Use Permit to operate a Tap Room and Continue Brewery Operations, Case No. CU 20- !5 Mr. Carlton presented the staff report. Chair Larson-Vito opened the public hearing. Tim Jones and Jeremy Jones, the applicants, were available to answer quesdons. Chair Latson-Vito asked if they had any questions or coflcems about the conditions. Jeremy Jones stated their biggest issue is parking and requested considetadon fot parking on the street to count toward their overall parking requirements. He stated he does not see aflyolre currendy parking on the street as the building is in an\- Planning Commission August 24,2020 Page 2 industrial development. He noted their business would have the highest patrons in the evenings when the surrounding businesses would not be open. Tim stated fot the btewing portion of the business, 6 parking stalls are required, and he is the only brewer. He stated he understands the parking requirements are based on square footage but asked if a parking variance could be consideted. Jeremy noted the gtounds layout and stated they would eventually be taking over the entire 9,000 sq. ft. building when the cuffent tenaflts' leases are due. He explained the grounds layout with a future dog park aret andpatio, which would be all connected and contiguous to comply with the state's alcohol requirements. He stated they are open to suggestions with site layout to comply with city requirements. Commissioner Thiel stated parking is always an issue and he petsonally is a stickler for ensuring the parking requirement rados are met for current and future uses. CommissionerJohnson asked how many barrels is being brewed as ordinance limits the number of barels to 20,000 barrels annually. The applicants stated they have btewed apptoximately 364 barrels this year. CommissionerJohnson asked for more infotmation about the tequirements for parking and stated going ftom 32 to 69 parking spots is a big jump in the numbet of parking spots. Mr. Leeseberg stated the parking requirements for tap rooms ate extremely high at 1 parking spot for every 50 square feet of building. He suggested a vadance to those requirements. The Planning Commission discussed the options for adding additional patking stalls and the applicants stated they were oPen to making it work while they continue expanding into the endre building. There being no one else to speak, Chair Larson-Vito closed the public hearing. Chair Larson-Vito asked for clarification that if the applicaflt wants to fequest a change arrdvary number of parking spots, would they then have to go through the variance application process. Mt. Leesebetg stated that was correct. Commissioner Beise asked if all the patking spots had to be in place before they opened the business. Mr. Leeseberg stated technica\ yes, before construcdon of the facility the conditions must be met and the conditional use permit filed with Sherbume County, but the applicant has two years to complete those conditions before opetating their business. Commissionet Johnson stated it sounded like the applicants were open to accommodating what the ordinance requires and felt they could get created on how they would use the site over time and while expanding, but wanted to ensure they weren't impeded by the requirements and were able to grow into their plans. Moved by CommissionetJohnson and seconded by Commissioner Rydbetg to fecommend approval of the Conditional Use Permit to opetate a tap foom and continue brewery operations at 19050Industdal Blvd. with the following conditions: 1. The Conditional Use Permit shall not be recorded until the city building official and fire matshal have inspected, and approved, the building fot compliance with all state and local building codes. 2. No mote than 20,000 barels of its own btands of malt liquot may be brewed annually. 3. A minimum of 69 parking stall shall be ptovided on the subiect property. 4. A single outdoor patio location exhibit shall be submitted and approved by city staff. 5. The outdoor patio atea shall be delineated with a pennanent fence. 6. Expansion of the tap room andf or the microbrewery will tequite an amendment to the Conditional Use Permit. Motion catded 6-0.
