The general purpose and intent of the ordinance are met. 2. The property has a land use of residential and the use is consistent with the Comprehensive Plan. 3. The proposed use is reasonable and is permitted in the zoning CR 33 ordinance. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction. 5. A,;io /89 Figure Background/Discussion The city and school district are working together to create a sign package for the Furniture and Things Community Event Center and Elk River High School (ERHS). The city would like to install a sign on the wall of the Furniture and Things Community Event Center to identify the building and the main sponsor (Furniture and Things) of the facility. Ordinances currently limit the sign size to 92 SF,which may not be visible from the street. The proposed sign is approximately 200 to 250 SF. Updated.August 2020 The city and ERHS propose a sign near the entrance to the high school parking lot that would advertise both facilities. There would also be a changeable copy portion of the sign to advertise different events at both facilities. Construction of this sign will exceed the sign limitations for school properties as well. Applicable Regulation Variances may be granted when the petitioner establishes that the variance satisfies all five of the criteria described below. The variance is: 1. Is in harmony with the general purpose and intent of the ordinance,and The general purpose and intent are to allow one mall and ane freestanding sign for each propenyl busines. The Furniture and Things Community Event Center is on its own landlocked parcel about 550 feet anray from School Street. Due to the distance from the street as well as the parcel being landlocked, the general purpose and intent mould be met. 2. Is consistent with the City of Elk River Comprehensive Plan. The properties areguided for residential, nrhich allonr educational institutions andgovernment facilities. It is consistent with the comprehensive plan. Variances may be granted when the petitioner establishes that there are practical difficulties in complying with the zoning ordinance. Practical difficulties means that: 3. The petitioner proposes to use the property in a reasonable manner not permitted by the zoning ordinance; Wl'hile the school district already has a freestanding sign, the second sign is being utili.Ze for the Furniture and Things Community Event Center as well as the school. It is reasonable to have one mall and one freestanding sign for each propenyl business. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction;and The Furniture and Things Community Event Center landlocked property was created at some point in the past nrith the a significant distance from a public road This unique circumstance is not a consequence of the petitioner's own action or inaction. 5. The variance,if granted,will not alter the essential character of the locality. Financial Impact None Council Meeting If denied, or an appeal is made by any interested party by November 6,2020, this item will go to the November 16, 2020, City Council meeting.
