Background/Discussion Minnesota Statutes Section 429.101 authorizes the city to levy an assessment against a property for unpaid special charges. The property owner has signed a “Petition, Waiver and Agreement for Payment of the Cost of Installation and Connection of, or Repairs to, Private Utility Lines and Assessment of Amounts Paid as a Special Charge Under Minnesota Statutes, Section 429.101” allowing the city to assess the charges incurred for repairs to the private water service connecting to the city water line. The total amount assessed for the repairs is $11,714.00. Updated: August 2020 City of Elk River City Council Resolution 20-___ A Resolution of the City Council of the City of Elk River Adopting and Levying Assessment for Costs Incurred to Connect to City Water Lines WHEREAS, Minnesota Statutes Section 429.01 authorizes the Municipality to levy assessment against the property for unpaid special charges; and, WHEREAS, the property owners have requested that the city allow them to connect to the water lines which adjoin the property; and, WHEREAS, the property owner has signed a “Petition, Waiver and Agreement for Payment of the Cost of Repairs to Private Water Line and Assessment of Amounts Paid as a Special Charge Under Minnesota Statutes 429.101” to allow the connection costs to be levied as an assessment against their property; and, WHEREAS, state law does not require a public hearing or notice before levying such assessments.
