Overview
The proposed site is the location of the Broadway Pizza and Bar restaurant. The applicant is
proposing to construct a 24' x 36' patio on the north end of the building. It will be utilized
as an outdoor eating area. Due to sales of liquor, the patio will be fenced with an emergency
gate.
They are also requesting approval of a 30x40 storage building. This will be utilized for the
storage of maintenance equipment and restaurant supplies. The proposed building location
meets the setback requirements.
Standards for Issuance of a Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed
location:
1. Will not endanger, it!fure or detrimentallY qffect the use and et!fqyment of other proper(} in the
immediate vicini!J or the public health, sqfe!J, morals, comfort, convenience or general welfare of the
neighborhood or the ci!J.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderlY development and improvement of surrounding vacant
proper(}.
4. Will be served adequatelY ry and will not adverselY qffect essential public facilities and services
including streets, police and fire protection, drainage, refuse disposal, water and sewer !)1st ems, parks
and schools; and will not, in particular, create trqffic congestion or inteiference with trqffic on
ac:fjacent and neighboring public thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will
be detrimental to a1!Y persons or proper(} because of excessive trqffic, noise, smoke, fumes, glare,
odors, dust or vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor
importance.
1. Will fullY complY with all other requirements of this Code, including a1!Y applicable requirements
and standards for the issuance of a license or permit to establish and operate the proposed use in the
ci!J.
If denial of such a permit should occur, it shall accompany recommendations or
determinations by findings or a report stating how the proposed use does not comply with
the standards set forth in Section 30-654.

Recommendation
Staff recommends that the Planning Commission recommend approval of the request with
the following conditions:
1. The patio shall be fenced with an emergency exit gate with required exiting
hardware, as required by code.
2. The accessory building shall comply with all building codes.
