Adopt, by motion, a resolution to determine parking restriction within 100-feet of the crosswalk located on 191
Ave NW at Hoover Street near Twin Lakes Elementary School.
Background/Discussion

On October 19, 2020, the City Council discussed a request to consider “No Parking” along 191 Avenue near
Twin Lakes Elementary. Consensus was to establish no vehicular parking within a certain distance from the
existing cross walk to assure improved visibility of pedestrians crossing the roadway. To aid in this decision and
future requests, staff has drafted a Parking Restriction Policy that includes standards for establishment of parking
restriction in this area and others.
Upon approval of the parking restriction resolution, signage will be established to designate the no parking area

along 191 Avenue.
Financial Impact
Signs will be produced and installed with internally. Costs are included within the current budget for sign
maintenance.

Parking Restriction Policy
Purpose
The City of Elk River seeks to optimize its procedure for determining roadway segments
that designate implementation and enforcement of no parking zones.
This policy defines how proposed no parking zones are evaluated and recommended for
application. Areas failing to meet the guidelines established in this policy will not be
recommended by staff for restrictions. The City Council will make the final decision.
Parking restrictions on city-owned streets are to be applied as determined by this policy. All
parking restriction requests received shall be analyzed using guidelines set by this policy.
Parking Restrictions
General parking restrictions are to be applied according to Minnesota State Statute 169.34
Prohibitions; Stopping, Parking.
MN State Statute 169.34 says: No person shall park a vehicle, except when necessary to
avoid conflict with traffic or in compliance with the directions of a police officer or traffic-
control device, in any of the following places:
on a sidewalk;
in front of a public or private driveway;
within an intersection;
within 10-feet of a fire hydrant;
on a crosswalk;
within 20-feet of a crosswalk at an intersection;
within 30-feet upon the approach to any flashing beacon, stop sign, or
traffic-control signal located at the side of a roadway;
between a safety zone and the adjacent curb or within 30-feet of points on
the curb immediately opposite the ends of a safety zone, unless a different
length is indicated by signs or markings;
within 50-feet of the nearest rail of a railroad crossing;
within 20-feet of the driveway entrance to any fire station and on the side of
a street opposite the entrance to any fire station within 75-feet of said
entrance when properly signed;
alongside or opposite any street excavation or obstruction when such
stopping, standing, or parking would obstruct traffic;
on the roadway side of any vehicle stopped or parked at the edge or curb of a
street;
upon any bridge or other elevated structure upon a highway or within a
highway tunnel;
within a bicycle lane, except when posted signs permit parking; or
at any place where official signs prohibit stopping.

To meet the safety goals and needs of the community, the city has the right to place
additional restrictions beyond those detailed in State Statute. Locations and guidance for
additional restriction areas may be considered as follows:
at public street intersections to maintain adequate sight triangles;
within 100-feet of a midblock crosswalk or a crosswalk adjacent to and serving a
school;
on designated state-aid routes where State-Aid Operations Chapter 8820 dictates a
streets width will not support parking;
on any existing commercial or industrial street that will not accommodate parking on
both sides without causing lane restrictions;
on standard residential streets that are seeing commercial or institutional parking uses
and this non-residential use is causing concerns for the ability to provide public
safety services; or
other special situations where documented accident history could be corrected by the
establishment of a parking restriction area.
Implementation and Establishment
Establishment of parking restrictions beyond statue provided restrictions above must be
done via an approved resolution and corresponding signage in accordance with the
Minnesota Manual on Uniform Traffic Control Devices.
Season Restrictions
In addition to snow event parking restrictions detailed in City Ordinance Sec 74-102,
seasonal effects of excessive snow storage may cause for additional temporary restrictions
beyond those detailed in this policy. If the temporary restrictions are necessary for location
specific areas, they will be temporarily signed as “No Parking” in accordance with the
Minnesota Manual on Uniform Traffic Control Devices. Should the temporary order be
necessary across the entire city, the restriction will be publicly posted in the local paper and
via all electronic media communication sources used by the city.

WHEREAS, Current parking policy has created concerns from residents related to traffic
flow and safety through the corridor, and

WHEREAS, A no parking zone is proposed within 100-feet of the crosswalk on 191
Avenue NW at the intersection of Hoover Street adjacent to Twin Lakes Elementary School,
and
WHEREAS, The above restrictions are supported by the Elk River Parking Restriction
Policy.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk

River, Minnesota, as follows: Restrict street parking on both sides of 191 Avenue within

100-feet of the crosswalk across 191 Avenue NW at Hoover Street.
