Background/Discussion Case No. CU 20-20 This application is part of the Elk River Municipal Utilities (ERMU ) building expansion project. Council approved a Zone Change (ZC 20- 03), Preliminary and Final Plat (P 20-13 & P 20-14), a Variance (V 20- 14), and an Easement Vacation (EV 20-05) for this site on November 16, 2020. This is the last applicant required for approval of the project. The subject site is at the southeast corner of the intersection of Main St. and Tipton Ave. The applicant is seeking a Conditional Use Permit (CUP) to construct a new detached 48,541 sgft maintenance facility and associated site improvements. Planning Commission The Planning Commission asked about the changes that required the project to come back for a second review. The applicant stated the big change came after they completed their final cost analysis associated with the civil work, the soil that must be removed, and the cost of the retaining wall. ERMU stated the updated plan will not require a retaining wall and will keep most of the soils on site. P I I E I 1 0 9Y NATURE Updated. August 2020 Traffic and noise impacts related to the expansion were also discussed. The applicant noted that the hours of operation will be the same as the existing use, and they do not expect that there will be any additional noise. The applicant also noted that employees will begin using the two northern entrances, and truck traffic will use the driveways along the west side of the site. ERMU does not anticipate significant traffic increases but that additional deliveries are expected as they will have more storage space on site. During the public hearing, a resident asked the city to look at further setbacks and screening to mitigate the traffic, noise, and lights to the neighboring homes. Since the Planning Commission meeting, a second resident shared some questions and concerns. The building exterior is very industrial and is not compatible with the homes that surround it. The landscape buffer will need to be carefully designed and installed to protect the integrity of the residential nature of the neighborhood. "If you were a homeowner living across the street from the proposed building, what would you want to see as a buffer?" The commission wanted to make sure any storage or dumpsters, especially on the west side of the building, be screened with materials that matched the building. The commission unanimously recommended approval of the request. The project already received council approval for a Zone Change (ZC 20-03), Preliminary and Final Plat (P 20-13 & P 20-14), a Variance (V 20-14), and an Easement Vacation (EV 20-05). The subject site is at the southeast corner of the intersection of Main St. and Tipton Ave. The applicant is seeking a CUP to construct a new maintenance facility and associated site improvements. The site includes several parcels platted into one parcel. The existing homes will be removed, but the power plant and utility building will remain as part of the new maintenance complex. A new detached 48,541 sq. ft. building will be constructed roughly in the middle of the north half of the site and includes space for office and vehicle storage. The building exterior will be constructed using precast concrete panels, metal wall panels and face brick. The site currently has three access points on Main Street along the west side of property. They have proposed adding an additional access on Main Street on the north side of the property. August 2020 office building. The two other access points will be for company vehicle circulation to and from the storage garage and yard. The larger paved area on the west side of the building may have dumpsters and scrap metal along the wall between the two garage doors. Plans add screening around the dumpsters to keep them out of sight from neighboring properties. Work vehicles would be within the gated area, south and east of the proposed building, and they should not have any parked in the western paved area throughout the day. Signage is not indicated on the submitted plans. A sign permit will be required prior to installation, and must comply with setback, size, and height requirements. The new building will operate under the same hours of operation as the current facility, Monday — Friday from 7:00 a.m. to 3:30 p.m. ERMU employs 30 people at this location and the new building will provide space for planned employment growth. The landscape plan shows 43 trees will be added to the site to partially screen the parking and building from the adjacent roadways. In addition, the vehicle operations are to the rear of the site screened by the buildings. Applicable Regulations In approving a Conditional Use Permit, the council may impose such specific conditions with regard to the development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city. The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location: 1. mill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience orgeneral n elfare of the neighborhood or the city. The ERMU facility has been located on the site for many years. With the proposed grading, much of the site will be below the grade of Main Street and most of the outdoor areas will be screened from the public by trees, buildings, and elevation changes. The use will not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public health, safety, morals, comfort, convenience, or general welfare of the neighborhood or the city. With the landscaping and site layout proposed, staff does not see a need to impose additional conditions to satisfy this standard. 2. mill be consistent with the Comprehensive Plan. The subject area has an underlying land us of Mississippi Connections which is consistent with the R1-c zoning district where Governmental Facilities are allowed. I have discussed these items with Chris Kerzman, ERMU engineer, and also mentioned them to Chris Leeseberg, City of Elk River Senior Planner. Both the ERMU and the City Planning Department have been helpful to me. *Section 30-654 "...requirements contained in this article ... to promote compatibility with and minimize any potentially adverse effects upon adjacent properties, the neighborhood or the city." Standard 1. The issue of detrimentally affecting the use and enjoyment of other property in the neighborhood... -The proposed building is very large (48,541 sq. ft.) and the exterior design is industrial. The size and design are not compatible with the homes in this residential zone. -The landscape buffer is extremely important in meeting this standard and it will need to be carefully designed and installed in order to protect the integrity of the residential nature of the neighborhood. The proposed expansion will replace two existing homes. My concern is that the amount allocated for the buffer design and installation is adequate to cover the total cost, including potential changes and adjustments. I appreciate the opportunity offered to me by planning staff to be included in the process as things move forward. It's very important to me as a long term resident of the neighborhood. Standard 5. The issue of the detrimental activities such as glare, noise and traffic, has already been addressed by the hours of operation limit cited by staff.
