89-044 RES . . . NOTICE OF COMPLETION OF PROCEEDINGS RESOLUTION 89-44 A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION FOR VACATING A PORTION OF A DRAINAGE EASEMENT WHEREAS, a majority of the property owners abutting the drainage easement have requested the City Council in a petition dated 5/23/89 to vacate such easement according to law; and, WHEREAS, a public hearing was held on 6/19/89 before the City Council at the Elk River Public Library on such petition after due published and posted notice had been given, as well as personal notice to affected property owners by the clerk on 6/4/89 and all persons interested were given an opportunity to be heard; and, WHEREAS, it appears that it will be in the best interest of the City to approve such petition. NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby granted and the portion of the drainage easement described as follows is hereby vacated: That part of the drainage easement within Lot 24, Block 7, BRENTWOOD, Sherburne county, Minnesota which lies East of the following described Line B: Line A is described as a line extended from a point on the North line of said Lot 24 distant 96.17 feet West of the Northeast corner of said Lot 24, as measured along said North line, Southwesterly to a point on the South line of said Lot 24 distant 125.00 feet West of the Southeast corner of said Lot 24, as measured along said South line. Line B is described as follows: Commencing at a point on the North line of said Lot 24 distant 96.17 feet West of the Northeast corner of said Lot 24 distant 96.17 feet West of the Northeast corner of said Lot 24, as measured along said North line, said point also being the Northerly point of the above described Line A a distance of 15.00 feet to the Point of Beginning of the Line to be described; thence southerly deflecting to the left 26 degrees 53 minutes 00 seconds a distance of 80.00 feet; thence Southwesterly deflecting to the right 73 degrees 07 minutes 00 seconds a distance of 51.00 feet, more or less, to intersect the above described Line A and there terminating.
