RESOLUTION 89 - 48
A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING A PORTION OF A DRAINAGE
AND UTILITY EASEMENT
WHEREAS, a majority of the property owners abutting the portion
of the drainage and utility easement have requested the
City Council in a petition dated June 22, 1989, to
vacate such easement according to law; and,
WHEREAS, a public hearing was held on June 17, 1989, before the
City Council at the Elk River Public Library on such
petition after due published and posted notice had been
given, as well as personal notice to affected property
owners by the clerk on June 7, 1989, and all persons
interested were given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the
city to approve such petition;
NOW, THEREFORE, BE IT RESOLVED, that such petition is hereby
granted and the portion of the drainage and utility
easement described as follows is hereby vacated:

That part of Lot 4, Block 2, Meadowvale Woods, Sherburne
County, Minnesota, described as beginning at the
southwest corner of said Lot 4; thence north 3 degrees
26 minutes 34 seconds east along the west line thereof
for 142.70 feet; thence south 86 degrees 33 minutes 26
seconds east for 87.10 feet; thence south 43 degrees 41
minutes 00 seconds east for 117.14 feet; thence south
56 degrees 9 minutes 30 seconds west for 104.00 feet,
more or less, to intersect the south line of said Lot 4
at a point thereon a distance of 90.20 feet east of
said south west corner thereof; thence north 86 degrees
33 minutes 26 seconds west along said south line for
90.20 feet to the point of beginning.
