89-064 RES . . . CITY OF ELK RIVER COUNTY OF SHERBURNE RESOLUTION 89-64 WHEREAS, the building, located at 15536 Cleveland Street, City of Elk River, County of Sherburne, State of Minnesota, and legally described as part of the Northwest Quarter of the Northeast Quarter of Section 24, Township 32, Range 26, Sherburne County, Minnesota, PID 117-000-241-213 (Subject Property) burned on or about September 12, 1989; and WHEREAS, the City Council for the City of Elk River finds as follows: 1. That RCM International, a producer of poly vinyl chloride products, operates its business on the Subject Property. 2. That the Subject Property is presently unoccupied. 3. That the remaining portions of the structure are unsound. 4. That there is broken glass, metal objects, and unsecured portions of the structure which threaten the public safety. 5. That the subject property is an attraction to children and poses an unreasonable risk of harm to children and others. 6. That there is a threat of contamination to the on-site well. 7. That there is a threat of contamination to the surrounding soils from the on- site septic system. 8. That the building is beyond repair. 9. That the aforementioned conditions present a hazard to the public safety or health. WHEREAS, the debris from said fire has left the Subject Property in a hazardous condition; and WHEREAS, the legal owner, John C. Hoglund, has not yet cured the aforesaid hazardous conditions. . . . NOW, THEREFORE, the City Council of the City of Elk River does hereby resolve: 1. That pursuant to the provisions of Minn. Stat. Chapter 463, and Section 500.08 of the City Code and in accordance therewith, the Town Board shall cause to have served upon the owner an order directing the owner to cure said hazardous condition. A true and correct copy of said order is attached hereto as Exhibit A and is incorporated herein. 2. That the City's attorney shall commence the necessary proceeding with all deliberate speed. Chapter 463 and Section 500.08 of the City of Elk River City Code, you John C. Hoglund, are hereby ordered, as owner of the property located at 15536 Cleveland Street, City of Elk River, County of Sherburne, State of Minnesota, and legally described as: Part of the Northwest Quarter of the Northeast Quarter of Section 24, Township 32, Range 26, County of Sherburne, Minnesota (Subject Property) to correct the hazardous condition on said property. 2. On or about september 12, 1989, a fire occurred on the Subject Property which completely destroyed the building thereon. The physical damage to the building was so extensive that it is beyond repair and the property remains in a hazardous condition as the debris from said fire remains. 3. You are hereby ordered to seal the well on the Subject Property by a licensed water well contractor. Furthermore, you are ordered to secure and stabilize the soils adjacent to the parking lot and to remove the block wall there. You are to remove any connecting lines and cap below ground all parts of the septic sewer system. You are to remove the sheet metal walls and remove any lumber, any glass, any other metal objects, and any other objects from the structure which pose a hazard or threaten the public safety. The ash from the fire is to be collected and removed and disposed of in a proper manner. You are to place a guard rail or fence around the area surrounding the upper parking lot. 4. You are hereby ordered to cure said defects within a reasonable time from the date of this order. 5. herein. You have 20 days in which to answer the averments 6.
