Resolution No. 85-10
A RESOLUTION DESIGNATING DEVELOPMENT DISTRICT NO. 1 AS A MUNICIPAL
DEVELOPMENT DISTRICT PURSUANT TO CHAPTER 472A OF MINNESOTA STATUTES,
APPROVING THE DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO.1,
AND DESIGNATING THE CITY ADMINISTRATOR AS THE ADMINISTRATOR OF
DEVELOPMENT DISTRICT NO.1.
The City Council for the City o~ Elk River (the City), acting
pursuant to its authority under Chapter 472A of Minnesota Statutes,
hereby finds, determines, and resOlves as follows:
FINDINGS
1. That there is a demand within the City for increased commercial
development.
2. That extensive commercial development of many areas within the
City designated for business and industrial use is not
possible absent the installation of certain public facilities
including improved water service, additional streets and
roads, and others.
3. That the high cost of constructing the required facilities
cannot be met, and additional business and industrial development
is therefore not possible, without public intervention.
4. That it is therefore necessary, desirable, and in the public
interest to designate, establish, develop, and administer a
development district (the Development District) in the City of
Elk River pursuant to Chapter 472A of Minnesota Statutes.
5. That the purpose of the Development District will be to provide
a means for financing certain public improvements and facilities
necessary if the City is to attract commercial and industrial
development and increase employment opportunities in those
areas of the City designated for these uses.
6. That the boundaries of the Development District shall be selected
to include those areas of the City which:
a.) Are zoned and planned for business and industrial development
but require that certain public improvements be installed to
make such development possible; and
b. )
Will have water service made available by proposed water service
improvements, therefore making development possib~e; and

c.) Have existing water service which will be improved by proposed
water service improvements.

7. That the proposed Development Program for Development District
No.1, prepared by City staff and consultants, adequately and
accurately sets forth the goals, objectives and other details
regarding the Development District.
8. That the Development Program has been submitted to and reviewed
by the Planning Commission for the City of Elk River and that
the Planning Commission has been consulted with respect thereto.
9. That the Development Program is consistent with the City's
Comprehensive and Land Use Plans.
10. That notice of a public hearing on the designation of the Develop-
ment District and adoption of the Development Program has been
published in the official newspaper of the City, as required by
Minnesota Statutes Section 472A.03.
11. That a public hearing on the designation of the Development District
and adoption of the Development Program was held before the
City Council on April 1, 1985 and that an opportunity to be
heard was granted at that time to all residents of the City and
to all other interested persons.
12. That designation of the Development District and adoption of the
Development Program is in the public interest because:
a.) It will discourage commerce, industry, or manufacturing
from moving their operations to another state: and
b.) It will result in increased employment in the City: and
c.) It will result in preservation and enhancement of the tax
base of the City.
RESOLVED:
A. That the City Council for the City of Elk River hereby designates
that portion of the City set forth on the map attached as Exhibit
A to the Development Program for Development District No. 1 as
Development District No. 1 of the City of Elk River.
B. That the objectives of Development District No. 1 shall be those
set forth in the Development Program for Development District No.
1.
C. That the City Council for the City of Elk River hereby adopts
the Development Program for Development District No. 1 in its
entirety.
D. That the City Administrator is hereby designated the Administrator
for Development District No. 1 and, for the purpose of administering
the Development District, is hereby granted all powers set forth
in Minnesota Statutes Section 472A.IO, subject to such rules and
limitations as may be adopted by the City Council.
