Call Meeting to Order 'Ne Pursuant to due call and notice thereof, the meeting of the Elk River Board of Adjustments was called to order at 6:30 p.m. by Acting Chair Thiel. ,. 2. Consider January 26, 2021, Board of Adjustments Agenda Moved by Commissioner Beise and seconded by Commissioner Jordan to approve the January 26, 2021, Board of Adjustments agenda. Motion carried 7-0. 3. Consider November 24, 2020, Board of Adjustments Minutes Moved by Commissioner Rydberg and seconded by Commissioner Feinstein to approve the November 24, 2020, Board of Adjustments minutes. Motion carried 7-0. 4.1 Wold Architects & Engineers for ISD #728- 948 Proctor Ave. NW, 11970 Highland Rd. NW, and 900 School St. NW, Case No. V 2 1-01 ■ Accessory Structure Height Variance ■ Accessory Structure Quantity Variance ■ Signage, Quantity, and Dimension Variance Mr. Leeseberg presented the staff report. Acting Chair Thiel asked if the height of the structures could be lowered to meet the Board of Adjustments Minutes Page 2 January 26,2021 height restrictions and not require a variance,wondering if the area of the structures could be reviewed separately from the structure height. Mr. Leeseberg stated the area and height variances could be reviewed together or separately,whichever the commission preferred. Acting Chair Thiel opened the public hearing. He asked the district representatives if the structure heights of 16'-8" could be lowered to meet the restriction. Patrick Triggs and Justin Lenz, representing Wold Architects and Engineers, stated they worked to minimize the height of those structures as much as possible and arrived at the 16'-8" slope to meet certain criteria. He stated with its use as a storage building, there were limitations of how low they could make the openings to allow loading and unloading of equipment. Mr. Triggs stated as a result, the openings needed to be a certain size. He stated because the roofs are gabled, they need to maintain a certain slope to allow proper drainage and to meet the roofing warranty. Therefore,he stated they determined the roof needed to be 16'-8". There being no one else to speak,Acting Chair Thiel closed the public hearing. Commissioner Johnson stated he was in favor of approving the variances, due to the uniqueness of the property multiple uses, and he had no issue approving it. Commissioner Jordan agreed with Commissioner Johnson,noting there were no other homes nearby and the project will not affect anyone's line of sight. Moved by Commissioner Beise and seconded by Commissioner Rydberg to approve the accessory structure height and quantity variances, and the sign quantity and dimension variances as noted below, for the following reasons: 1. The general purpose and intent of the ordinance are met. The property has a land use of Residential and the uses are consistent with the Comprehensive Plan. The proposed uses are reasonable and are permitted in the zoning ordinance. 4. The plight of the petitioner is due to circumstances unique to the property not a consequence of the petitioner's own action or inaction. 5. The variance will not alter the essential character of the locality. Four accessory structures, one press box, two team rooms/storage and one ticketing/concession, for a total of 9,545 square feet: Structure Area Height Press Box 540 33'-3" Home Team Room/Storage 3,000 16'-8" Visitor Team Room/Storage 2,444 16'-8" Ticketing/Concessions 3,561 2P-4" p 0 W I R I D 0 NATUREI Board of Adjustments Minutes Page 3 January 26,2021 ----------------------------- Schools, in residentially zoned areas, are allowed one freestanding sign and one wall sign not to exceed 96 square feet in total sign area. Where a zoning lot has more than 1,000 linear feet of combined street frontage, the total sign area shall not exceed 192 square feet with no more than 96 square feet per sign. This zoning lot qualifies for the additional square footage. Freestanding signage shall not exceed 20 feet in height. The applicant is requesting five signs totaling 301 square feet.
