Revised Ordinance No. 05-_ Per the City Council's direction onJuly 18th, staff has amended the ordinance to reflect the discussion relating to overnight parking. Recommendation Staff recommends that the City Council adopt the amended ordinance related to parking. Per the City Council's direction, enforcement of the parking limitations will begin as soon as the ordinance is published and becomes effective (August 10, 2005 at the earliest). Staff is working on ensuring that signs are correct and in place and preparing a letter to downtown businesses and residents regarding parking enforcement and availability of permits, which have arrived. S:\PLANNING\Case Files\2005\OA 05-10 City ofER Parking\08 0105 cc memo. doc ORDINANCE 05 - CITY OF ELK RIVER AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING SECTIONS 74-97 AND 74-99 OF THE CITY CODE OF ORDINANCES Case No. OA 05 - 10 The City Council of the City of Elk River does hereby ordain as follows: Section 1. Section 74-97 titled Nighttime parking in Business District of the City of Elk River Code of Ordinances shall be amended read as follows: Sec. 74-97. Nighttime parking. (a) No vehicle shall be parked between 2:00 a.m. and 6:00 a.m. on Lowell and Jackson A venues between Highway 10 and Main Street, on Main Street between Lowell Avenue and Highway 10, on J ackson Avenue between Highway 10 and 5th Street, and on Railroad Drive. In addition, no vehicle shall be parked between 2:00 a.m. and 6:00 a.m. in the municipal parking lots along the Burlington Northern Railroad. (b) No vehicle shall be parked between 2:00 a.m. and 6:00 a.m. in the King Avenue parking lot unless it is displaying a resident parking permit as issued by the Police Chief or his designee. (c) Violations of this section are punishable as provided in section 74-91. Section 2. Section 74-99 titled Reserved Parking in Municipal Parking Lots of the City of Elk River Code of Ordinances shall be amended read as follows: Sec. 74-99. Parking in municipal parking lots. (a) The municipal parking lots along the Burlington Northern Railroad are designated for either commuter or public parking. (b) The posted employee parking area within the King Avenue parking lot requires employee vehicles to display parking permits as issued by the Police Chief or his designee. (c) Violations of this section are punishable as provided in section 74-91. Section 3. That this ordinance shall take effect upon publication as provided by law.
