SR 08-01-2005 * Item # 3.10* MEMORANDUM TO: Mayor and City Council FROM: Joan Schmidt, City Clerk DATE: August 1, 2005 SUBJECT: Application to Conduct Off-Site Gambling by Elk River Youth Hockey REQUEST The Elk River Youth Hockey has requested an application to conduct off-site gambling. While looking through their records, I discovered that they never asked to change their premises permit to conduct charitable gambling from Mitch Miller's Olde Town Tavern to McCoy's Pub which is the name of the current business at that location (651 Main Street). I have put together a resolution for this purpose and also for them to conduct off-site gambling. The Elk River Youth Hockey would conduct off~site gambling for pull-tabs and a raffle on September 9, 2005 as part of their annual Fundraising Golf Tournament for Elk River Youth Hockey. This event will take place at the Elk River Country Club. Because the raffle event will not take place at the location of the Premise Permit, the State requires that the Council adopt a resolution approving an application for off-site gambling. ACTION REQUESTED Council motion adopting the two attached resolutions (1) approving a premises permit for the Elk River Youth Hockey Association to conduct lawful charitable gambling at McCoys Pub until the expiration date of June 30, 2006; and (2) for the Elk River Youth Hockey Association to conduct annual off-site gambling. RESOLUTION #05-_ A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION APPROVING PREMISES PERMIT RENEWAL FOR THE ELK RIVER YOUTH HOCKEY ASSOCIATION WHEREAS, The Elk River Youth Hockey Association has made application to the State Gambling Control Board for a Premises Permit Renewal; and, WHEREAS, the Premises Permit will allow charitable gambling on the premises of McCoys Pub (which is the former Mitch Miller's Olde Town Tavern) located at 651 Main Street in the City of Elk River until June 30, 2006; and, WHEREAS, The Elk River Youth Hockey Association has met the city's requirement of spending 75 percent of its lawful expenditures within the city's trade area during the past two years. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that a Premises Permit be granted to The Elk River Youth Hockey Association to allow charitable gambling operations at McCoys Pub located at 651 Main Street in the City of Elk River, Minnesota. Passed and adopted this 1st day of August 2005. Stephanie Klinzing, Mayor ATTEST: Joan Schmidt, City Clerk RESOLUTION #05- RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION APPROVING APPLICATION TO CONDUCT ANNUAL OFF-SITE GAMBLING FOR ELK RIVER YOUTH HOCKEY WHEREAS, The Elk River Youth Hockey has made application to the State Gambling Control Board for an application to conduct annual off-site gambling; and, WHEREAS, approval of the application would allow the Elk River Youth Hockey to conduct one raffle during the year; and, WHEREAS, the selling of pull-tabs and raffle event would be conducted at the Elk River Country Club which is off-site from the licensed Premise Permit site. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that an application to Conduct Annual Off-Site Gambling is granted to the Elk River Youth Hockey to allow the sale of pull- tabs and a raffle to be held September 9, 2005, at the Elk River Country Club.
