Action Requested
Recommend, by motion, approval of the Conditional Use Permit with
the following conditions to satisfy the standards set forth in Section _
30-654:
1. The west access easement shown in the original site plan
approval from October 2015 shall be recorded.

Background/Discussion
The property is zoned FAST Subzone H where light manufacturing
facilities require a Conditional Use Permit (CUP). x

The applicant is seeking a CUP to construct an approximately 90,000
square foot addition to their existing 105,000 light manufacturing HWLI

The project meets the exterior design standards (precast concrete
panels with a ribbed pattern matching the existing color) for the FAST `
- Subzone H zoning district and includes 82 trees which complies with
the city's landscaping standards. ! y

The setback and parking standards are satisfied under the submitted
proposal. Access to the site will occur at three points along 168"'

The loading dock doors are located along the south side of the structure, opposite public streets.
Applicable Regulations
In approving a Conditional Use Permit,the council may impose such specific conditions with regard to the
development or operation of the proposed use as it considers necessary to satisfy the seven standards set forth in
Section 30-654 and the requirements contained in this article and to promote compatibility with and minimize any
potentially adverse effects upon adjacent properties, the neighborhood or the city.

The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. mill not endanger, injure or detrimentally affect the use and enjoyment of other property in the immediate vicinity or the public
health, safety, morals, comfort, convenience or'g n elfare of the neighborhood or the city.
The proposed use is an extension of the use currently operating on the property. The only nearby use is a
semi-tractor dealership. The use will not endanger,injure or detrimentally affect the use and enjoyment of
other property in the immediate vicinity or the public health, safety,morals, comfort, convenience, or
general welfare of the neighborhood or the city.
Staff does not see a need to impose specific conditions to satisfy this standard.
2. mill be consistent nvith the comprehensive plan.
The property is guided for FAST,which promotes light manufacturing uses. The use will be consistent
with the comprehensive plan.

There are three vacant parcels in the development west of the subject site, also guided for the same types
of uses. East of the subject site is the Cargill land which is currently used for agriculture. The proposed
use will not impede the normal and orderly development and improvement of these surrounding vacant
properties.
Additionally, the parcel along the southwest corner of subject site does not have access to a public street.
During a past Easement Vacation (EV 15-08) an access easement was required on the west portion of the
property which was never recorded. Access to this parcel was to be provided through said easement—
which is shown on the submitted lighting plan. Recording the easement was a requirement of the original
site plan approval but has not yet been completed.
Staff included the condition to record the access easement as shown. This will provide access to adjacent
vacant property.
4. mill be served adequately by and will not adversely affect essential public facilities and services including streets,police and fare
protection, drainage, refuse disposal, water and sewer systems,parks and schools;and will not, in particular, create traffic
congestion or interference with traffic on adjacent and neighboring public thoroughfares.

o Project Narrative: SPORTECH, Inc. plans on expanding their production by adding a
90,080 sf addition to their existing 105,000 sf facility in the Nature’s Edge Business
Center Park. The addition should still remain consistent with the Elk River
comprehensive plan. Currently, the existing facility has 211 parking stalls and additional
77 parking stalls are being planned for the addition. There is no proposed screening of
the site planned. The proposed building materials will be replicated to the existing red
river rock precast panels along with similar elevations to be mirrored along all sides of
the addition. There is currently one building mounted sign shown on the building
elevations located at the North East corner of the Building is planned. This signage
would be very similar to the previous signage installed on the NE Corner. A separate
permit will be submitted, for this signage. No outdoor storage is planned for the
project. Below are Sportechs normal hours of Operation and the number of employees.
• Monday – Thursday – 5am – 1am (2 shifts, 5am – 3pm / 3pm – 1am)
• F-S-S – 6am – 6pm
• Total Roster – 250 people, indirect and direct
