An E-bike has a rechargeable battery-operated motor that assists an operator with the peddling of the bicycle over uneven or hilly terrain. According to state statute, a governing body may not prohibit or restrict operations of an electric- assisted bicycle on any bikeway or roadway unless the governing body can determine it is unsafe. Which is an ADA protection. MORC has indicated E-bikes are not determinantal to the mountain bike community or the trails. A new ADA regulation requires public agencies to review their policies to permit the reasonable use of power-driven “mobility devices” which includes electric bikes (ADA Title II Sec. 35.137). MORC brought to our attention the growing use of electric skateboards or one-wheel devices which are currently not classified under state statute. As prices decrease and this technology develops, we expect to see more use in parks.
