The nine motions described on the previous page represent three classes of motions:
MAIN (main); (SUBSIDIARY (amend, commit, postpone to a certain time, limit
debate, previous question, lay on table); PRIVILEGED (recess, adjourn). These
motions are in the order of their precedence with 1 (main) being the lowest and 9
(adjourn) being the highest.
The last group of motions to be listed is classified as INCIDENTAL and will not be
numbered because their precedence is different. An incidental motion is in order only
when it is legitimately incidental to another pending motion, or when it is legitimately
incidental in some other way to business at hand; it then takes precedence over any
motions that are pending.

Resolution for Reimbursement of Capital Expenditures
ACTION REQUESTED:
AdoptResolutionNo. 21-1 Declaring the Official Intent to Reimburse Certain Capital
Expenditures from the Proceeds of Tax-Exempt Bonds and Establishing Compliance with
Reimbursement Bond Regulations Under the Internal Revenue Code.
BACKGROUND:
Elk River Municipal Utilitiesintends to expand its field services facility to have indoor parking
for all of its equipment and vehicles, hold inventory in one secured area, and expand its office
space. We will be bonding for this in 2021, and the funds will be received in the spring.As
certain expenditures will occur prior to the funding being received, ERMU intends to pay for
these expenditures and then reimburse the companywhen the bond funds are received.
DISCUSSION:
The IRS has guidelines for an entity toreimburse themselves out of bond funds for expenses
already incurred. As ERMU intends to be compliant with these requirements, bond counsel has
prepared a resolution for the commission to adopt stating this intent. The amount listed is
$14,000,000, which will cover our budgeted $12,500,000 amount for the building, plus bond
issuance costs.

Field Services Facility Expansion Project – Plans, Project Estimate, and Construction
Management Contract
ACTION REQUESTED:
Authorize staff to solicit for public bids on the Field Services Expansion Project contingent upon
staff review and approval of bid documents.
Approve the A133 contract with RJM for construction management services.
BACKGROUND:
Staff is continuing to workwith Kodet Architectural Group, Ltd.and RJMConstructionon plans
for the Field Services Facility.The design is currently in the construction documents(CD)phase,
with staff receiving50% CD drawings and specifications during the week of February 1 for
review.
DISCUSSION:
Staff has been negotiating a contract with RJM. Due to updated versions of the American
Institute of Architects documents since the last project RJM has completed in Elk River,
Kennedy & Graven, Charteredand RJM needed to review the bidding process and the A133
contract. The proposed A133 contract for construction management services is attached for
commission approval.
Kodet and RJM have put together a project estimate based on previous projects, contractor
walkthroughs, and input from subcontractors in the area. Current drawings and the project
estimate are attached, staff will receive an updated estimate based off construction documents
near the end of February.
The current bond market and construction bids are favorable but costs of both are expected to
increase as we move forward. We are currently targeting the end of February to solicit for
public bids, with a bid opening near the end of March, and award of bids at the April
commission meeting.
FINANCIAL IMPACT:
Staff had been planning for a project budget of $12.5 million during budget preparation at the
end of last year. Current estimates that include RJM input have the project at approximately

$13.5 million. Staff has worked with bond council to review options and the planisto issue
bonds for the project costs, using construction bids received at the end of March to finalize the
bond amount. As these costs area significant portion of our upcoming capital budgets, staff
also reached out to Dave BergConsulting, LLC. Theydid not note any concern with the
increased bonding and projections of long-term financial outlook.

2020Annual Safety Report
ACTION REQUESTED:
None
BACKGROUND:
Minnesota Rules Chapter 7826 Public Utilities Commission Electric Utility Standards cover
safety, reliability, service, and reporting requirements. Per 7826.0100(A), municipal utilities are
exempt from these requirements. However, the Elk River Municipal Utilities Commission
adopteda number of parts of this chapter as a Distribution Reliability Standard policy. This
policy includes an Annual Safety Report requirement. The policy requires ERMU to “file an
annual safety performance report with its local governing body. The report will include
summaries of all reports filed with the Occupational Safety and Health Administration (OSHA)
and the Occupational Safety and Health Division of the Minnesota Departmentof Labor and
Industry during the calendar year.” Elk River Municipal Utilities only files the OSHA Form 300A.
DISCUSSION:
In 2020, there was 0 recordable cases which resulted in 0 days away from work. Attached is the
OSHA Form 300A that has been filed. It is a summary of work-related first report of injuries and
illnesses. Also attached is the OSHA Form 300A from 2019 for reference.
