86-016 RES RESOLUTION 86- 16 RESOLUTION AUTHORIZING PARTIAL PAY ESTIMATE NUMBER 5 FOR ELEVATED WATER TOWER PROJECT . WHEREAS, Hydrostorage, Inc. has requested a partial payment for the work performed on the City's elevated water tower; and, WHEREAS, the City's Consulting Engineer, Maier Stewart and Associates, Inc. has reviewed the request for partial payment and has found it to be correct. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota that: 1. Partial pay request 14 from Hydrostorage, Inc. is hereby approved in the amount of $15,981. MAINTENANCE AGREEMENT THIS AGREEMENT made and entered into by and between the City of Flk River hereinafter referred to as the "City" and the County of 411right hereinafter referred to as the "County". WHEREAS, it is deemed to the best interest of all parties that the duties and responsiblities of both the City and the County as to maintenance on Bridge 186515 and its approaches should be clearly defined, NOW THEREFORE, IT IS AGREED with regard to said structure maintenance: MAINTENANCE CITY RESPONSIBLE FOR: (1) Maintenance of street lights (2) Removal of snow from sidewalk (3) Maintenance of slopes/berms and roadway on north approach (includes: turf maintenance, bituminous maintenance, drainage and riprap maintenance) (4) Periodic sweeping to remove sand and debris and removing sand/dirt from expansion joints. ('5) Removal of markings/spray paint etc. from visible surfaces of bridge structure COUNTY RESPONSIBLE FOR: (1) Snow and ice control for bridge and approaches (2) Signing for bridge and approaches (3) Maintenance of slopes/berms and roadway on south . approach (includes: turf maintenance, bituminous .. · , maintenance I dra i nage and r iprap ma i ntenance) (4) Centerline and edge pavement marking (includes stop ba r ) . ' The agreement between the City and County shall be for a two year period and run from January I, 1986 to December 31, 1987. All maintenance responsibilities will be deemed "offsetting" therefore no payments will be required for the individual maintenance work which conforms to-the a~eas stated herein and performed under authorization of ei ther the City or ,,-....-.... .
