RESOLUTION 86-30
A RESOLUTION APPOINTING PATRICK D. KLAERS AS CITY ADMINISTRATOR
OF THE CITY OF ELK RIVER AND ESTABLISHING TERMS AND CONDITIONS
OF EMPLOYMENT
WHEREAS, it is the desire of the City Council of the City of Elk River to
provide for the appointment of the City Administrator and to
establish terms and conditions of employment for the City
Administrator;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Elk River as
follows:
1. Patrick D. Klaers is hereby appointed as City Administrator of
Elk River effective May 8. 1986.
2. Mr. Klaers shall perform the duties and meet the obligations for
the position of City Administrator as required by State Statute
and Section 202.02 of the Elk River City Code and other such
legally permissible and proper duties as the City Council may
assign.
3. Upon appointment, the salary for Mr. Klaers shall be $38,000 per
annum with a review to be done by the City Council at six
months. Adjustments to the City Administrator's salary shall be
reviewed annually in conjunction with the establishment of
salaries for City employees.
4. The City Administrator shall be granted sick leave and holiday
benefits granted to other employees and commencing upon
appointment he will earn three weeks vacation per year.
Additionally. upon appointment Mr. Klaers shall be credited with
30 days sick leave and 10 days vacation leave.
5. In addition to the specific prov~s~ons covered in this
resolution the City Administrator shall be entitled to all other
employment benefits provided to full time City employees by law.

6. The City agrees to pay Mr. Klaers $150/month for car allowance.
This car allowance is in lieu of providing the City
Administrator with a 24 hour City owned automobile which would
have included providing all costs of its operation and proper
insurance coverages.
7. The City agrees to budget and pay for the professional dues and
subscriptions of the City Administrator necessary for his
continuation in full participation in national. regional. state
and local associations an organizations necessary and desirable
for his continued professional participation. growth and
advancement and for the good of the City.

8. The City shall budget and pay for the cost of registration.
travel and subsistence relating to training programs which serve
to continue the professional educational development of the City
Administrator. including. but not limited to. the Annual
Conference of the International City Management association. the
Annual Conference of the Minnesota City Management Association
and the Annual Conference of the League of Minnesota Cities.
9. In the event of resignation. notice thereof shall be submitted
in writing to the City Council at least 30 days prior to the
effective date.
10. In the event of involuntary resignation or dismissal. severance
pay based on unpaid accrued vacation leave and three months
salary shall be paid to the City Administrator; however. in the
event the City Administrator is terminated because of his
conviction of any illegal act involving personal gain to him.
the City shall have no obligation to pay the aggregate severance
sum designated in this paragraph.
11. Minnesota State Law provides City Administrators with a choice
of pension plans; PERA or a deferred compensation fund. The
City of Elk River will contribute to the qualified fund of the
City Administrator's choice a dollar amount equivalent to the
required PERA contribution.
12. This appointment is expected to continue for at least three
years and the terms and conditions stated above will continue in
effect as long as Mr. Klaers serves as the Elk River City
Administrator unless renegotiated in a future contract.
