RESOLUTION 86- 42 A RESOLUTION ACCEPTING FEASIBILITY STUDY, ORDERING PROJECT, AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS FOR BITUMiNOUS OVERLAY PROJECT FOR KNOLLWOOD, KNOLLWOOD WEST, XNOLLWOOD WEST 2ND ADDITIONS AND ALL PROPERTIES ABUTTING ULYSSES STREET NORTH OF 199TH STREET WHEREAS, the Elk River City staff has held an informational meeting on May 15, 1986 with the residents in Knollwood, Knollwood West, Knollwood West Second, additons and all properties abutting Ulysses Street north of 199th street regarding proposed bituminous overlay improvements; and, WHEREAS, the Elk River City Council received and reviewed a report from the City Staff on said information meeting at its June 2nd Council meeting and did call for a Council public hearing on the proposed improvements of Knollwood, Knollwood West, Knollwood West Second, and all properties abutting Ulysses Street north of 199th Street; and, WHEREAS, ten days' mailed notice and two weeks' published notice of the hearing was given, and the hearing was held thereon the 7th day of July, 1986 and continuted to the 21st day of July, 1986, at which all persons desiring to be heard were given an opportunity to be heard thereon. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Elk River, Minnesota: 1. Such improvement is hereby ordered as prepared. 2. If the Project does not proceed, the money funded by the improvement bond can be used elsewhere. 3. This project is ordered with the understanding that the City Council is awaiting the results of the Tyler Street Study before proceeding with this project. 4. This project may proceed withy a petition presented by 35% of the residents in the affected area.
