Background/Discussion
On April 20, 2020, Council approved the Agreement for Professional Services to hire SRF Consulting to complete
the design and construction management for the Orono Park and the Youth Athletic Complex for $367,172. At
the December 21, 2020, meeting, Council approved the final designs and bid documents for Orono Park.
The Orono Park Site Improvements includes installation of three bituminous parking lots with entrance drives,
bituminous pathways, concrete walks and curbing, two sand volleyball courts, four pickleball courts, chain link
fencing, grading, utilities, stormwater infrastructure and turf management. The engineer's estimate for the base bid
site improvements was $1,671,050, with a total of 11 responsive bids and the lowest bidder New Look Contracting
coming in at $1,332,974. Attached is a letter and bid tabulations from SRF Consulting recommending the city
consider this bid and the bid alternate 1 for the installation of a Musco lighting system for the pickleball courts.
The skatepark contract is a Sourcervell public cooperative from Spoon Banco performing the installation and
construction services. A new skate park was identified as a priority in the 2015 Parks Master Plan with a then cost
estimate of $400,000. A skate park committee was formed in 2016 and workshops were held with the Parks and
Recreation Commission to later finalize the design.

A Sourcervell cooperative will also be utilized with Landscape Structures Inc. as the manufacturer and installation of
the splash pad. SRF will work with New Look Contracting to coordinate the electrical and mechanical system
improvements along with the entire construction areas to make sure the entire park grounds are prepared and
coordinated.
The toilet and park shelter buildings for the Orono Park project were designed and bid as pre-engineered
structures. The design team recommended this approach as it has been a successful delivery process for park
structures with other cities as well as the City of Elk River. The shelter facility matches the design features of the
shelters at Lion John Weicht Park and Woodland Trails Regional Park. The process for both the Orono and YAC
buildings saved the city $150,000 in costs over traditional field construction through a general contractor.
The prox card access will provide the public and city maintenance staff a prox card technology system so that staff
can program the building remotely to lock and unlock the Orono Toilet building. This will result in a substantial
labor savings by not requiring maintenance staff to do this daily.
The Parks and Recreation Commission recommended to update all the shelters at Orono Park. The shelter
proposed for this replacement is a basic design located in the Orono Park Master Plan and supported by the Parks
and Recreation Commission as ideal for summer camps and programming.
Staff estimates the cost to furnish the park with picnic tables, grills and benches is $60,000. Furnishings were not
calculated in the original Active Elk River costs. We expect to include this in the parks budget for 2022.

Dear Mayor and Council Members:
Bids were received for the above -referenced project on March 11, 2021 and were opened and read
aloud. A total of 11 responsive bids were received. The bids were checked for mathematical accuracy
and tabulated with errors highlighted in yellow on the bid tabulation. The Engineer's Estimate for
base bid was $1,671,050.98 and $72,500.00 for alternate #1. The bid tabulation indicates the low
bidder as New Look Contracting, Inc., Rogers, MN, in the amount of $1,332,974.00 and $75,000.00
for alternate #1, for a total bid of $1,407,974.00.
We recommend that the City consider these bids and award the contract to New Look Contracting,
Inc., based on the results of the bids received.

STANDARD FORM OF AGREEMENT
THIS AGREEMENT is by and between City of Elk River ("Owner") and New Look Contracting Inc. ("Contractor").
Owner and Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows:
ARTICLE 1— WORK
1.01 Contractor shall complete all Work as specified or indicated in the Contract Documents. The Work is generally
described as follows:
Bituminous drives and parking lots, curb & gutter, concrete walk, turf establishment, landscaping, erosion control,
signing and striping.
ARTICLE 2 — THE PROJECT
2.01 The Project for which the Work under the Contract Documents maybe the whole or only a part is generally
described as follows:

ARTICLE 3 — ENGINEER
3.01 The Project has been designed by SRF Consulting Group, Inc. (Engineer), who is to act as Owner's representative,
assume all duties and responsibilities, and have the rights and authority assigned to Engineer in the Contract
Documents in connection with the completion of the Work in accordance with the Contract Documents.
ARTICLE 4 — CONTRACT TIMES
4.1 Time of the Essence
A. All time limits for Milestones, if any, Substantial Completion, and completion and readiness for final payment as
stated in the Contract Documents are of the essence of the Contract.
4.2 Dates for Substantial Completion and Final Payment
A. All Work shall be substantially completed on or before Friday, October 15, 2021, and completed and ready for final
payment in accordance with Paragraph 14.07 of the General Conditions on or before Friday, October 29,2021.
4.3 Liquidated Damages
A. Contractor and Owner recognize that time is of the essence of this Agreement and that Owner will suffer financial
loss if the Work is not completed within the times specified in Paragraph 4.02 above, plus any extensions thereof
allowed in accordance with Article 12 of the General Conditions. The parties also recognize the delays, expense,
and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the
Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that
as liquidated damages for delay (but not as a penalty), Contractor shall pay Owner a daily charge for each day that
expires after the time specified in Paragraph 4.02 for Milestones and/or Substantial Completion until the Work for
the Milestones and/or Substantial Completion is complete. After Substantial Completion, if Contractor shall
neglect, refuse, or fail to complete the remaining Work within the Contract Time or any proper extension thereof
granted by Owner, Contractor shall pay Owner daily charge for each day that expires after the time specified in
Paragraph 4.02 for completion and readiness for final payment until the Work is completed and ready for final
payment. The daily charges will be based on the original contract value, and will be in the amount shown in the
following table:

ARTICLE 5 — CONTRACT PRICE
5.1 Owner shall pay Contractor for completion of the Work in accordance with the Contract Documents an amount in
current funds equal to the sum of the amounts determined pursuant to Paragraphs 5.01.A below:
A. For all Unit Price Work, an amount equal to the sum of the established unit price for each separately identified
item of Unit Price Work times the estimated quantity of that item as indicated in Contractor's Bid, attached hereto
as an exhibit.
As provided in Paragraph 11.03 of the General Conditions, estimated quantities are not guaranteed, and
determinations of actual quantities and classifications are to be made by Engineer as provided in Paragraph 9.07 of
the General Conditions. Unit prices have been computed as provided in Paragraph 11.03 of the General Conditions.
ESTIMATED TOTAL OF ALL UNIT PRICE WORK
ARTICLE 6 — PAYMENT PROCEDURES
6.1 Submittal and Processing ofPayments

A. Contractor shall submit Applications for Payment in accordance with Article 14 of the General Conditions.
Applications for Payment will be processed by Engineer as provided in the General Conditions.
6.2 Progress Payments; Retainage
A. Owner shall make progress payments on account of the Contract Price on the basis of Contractor's Applications
for Payment on or about the 15'11 day of each month during performance of the Work as provided in Paragraphs
6.02.A.1 and 6.02.A.2 below. All such payments will be measured by the schedule of values established as
provided in Paragraph 2.07.A of the General Conditions (and in the case of Unit Price Work based on the number
of units completed) or, in the event there is no schedule of values, as provided in the General Requirements:
1. Subject to the provisions of SC-14.02, progress payments will be made in an amount equal to the percentage
indicated below but, in each case, less the aggregate of payments previously made and less such amounts as
Engineer may determine or Owner may withhold, including but not limited to liquidated damages, in
accordance with Paragraph 14.02 of the General Conditions:
a. Ninety-five percent (95%) of Work completed (withthe balance being retainage).

b. Ninety-five percent (95%) of cost of materials and equipment not incorporated in the Work (with the
balance being retainage).
2. Upon Substantial Completion, Owner shall pay an amount sufficient to increase total payments to Contractor
to 100 percent of the Work completed, less such amounts as Engineer shall determine in accordance with
Paragraph 14.02.B.5 of the General Conditions and less 150 percent of Engineer's estimate of the value of
Work to be accepted or corrected as shown on the tentative list of items to be completed or corrected attached
to the certificate of Substantial Completion.
6.3 Final Payment
A. Upon final completion and acceptance of the Work in accordance with Paragraph 14.07 of the General Conditions,
Owner shall pay the remainder of the Contract Price as recommended by Engineer as provided in said Paragraph
14.07.
ARTICLE 7 — INTEREST
7.01 Not used.
ARTICLE 8 — CONTRACTOR'S REPRESENTATIONS
8.1 In order to induce Owner to enter into this Agreement Contractor makes the following representations:
A. Contractor has examined and carefully studied the Contract Documents and the other related data identified in the
Bidding Documents.
B. Contractor has visited the Site and become familiar with and is satisfied as to the general, local, and Site conditions
that may affect cost, progress, and performance of the Work.
C. Contractor is familiar with and is satisfied as to all federal, state, and local Laws and Regulations that may affect
cost, progress, and performance of the Work.
D. Contractor has carefully studied all: (1) reports of explorations and tests of subsurface conditions at or contiguous
to the Site and all drawings of physical conditions in or relating to existing surface or subsurface structures at or
contiguous to the Site (except Underground Facilities) which have been identified in the Supplementary Conditions
as provided in Paragraph 4.02 of the General Conditions and (2) reports and drawings of a Hazardous
Environmental Condition, if any, at the Site which has been identified in the Supplementary Conditions as provided
in Paragraph 4.06 of the General Conditions.
E. Contractor has obtained and carefully studied (or assumes responsibility for doing so) all additional or
supplementary examinations, investigations, explorations, tests, studies, and data concerning conditions (surface,
subsurface, and Underground Facilities) at or contiguous to the Site which may affect cost, progress, or
performance of the Work or which relate to any aspect of the means, methods, techniques, sequences, and
procedures of construction to be employed by Contractor, including any specific means, methods, techniques,
sequences, and procedures of construction expressly required by the Bidding Documents, and safety precautions
and programs incident thereto.
F. Contractor does not consider that any further examinations, investigations, explorations, tests, studies, or data are
necessary for the performance of the Work at the Contract Price, within the Contract Times, and in accordance
with the other terms and conditions of the Contract Documents.
G. Contractor is aware of the general nature of work to be performed by Owner and others at the Site that relates to
the Work as indicated in the Contract Documents.

H. Contractor has correlated the information known to Contractor, information and observations obtained from visits
to the Site, reports and drawings identified in the Contract Documents, and all additional examinations,
investigations, explorations, tests, studies, and data with the Contract Documents.
I. Contractor has given Engineer written notice of all conflicts, errors, ambiguities, or discrepancies that Contractor
has discovered in the Contract Documents, and the written resolution thereof by Engineer is acceptable to
Contractor.
J. The Contract Documents are generally sufficient to indicate and convey understanding of all terms and conditions
for performance and furnishing of the Work.
ARTICLE 9 — CONTRACT DOCUMENTS
9.1 Contents
A. The Contract Documents consist of the following:
1. This Agreement (pages 1 to 6 inclusive).
2. Construction Performance Bond (Document 00 61 11).
3. Construction Payment Bond (Document 00 6113).
4. General Conditions (pages 1 to 54, inclusive).
5. Supplementary Conditions (Document 00 73 00).
6. Specifications as listed inthe table of contents of the Project Manual.
7. Drawings consisting of 58 sheets with each sheet bearing the following general title: Orono Park General
Site Improvements
8. Addenda (numbers 1 to 2, inclusive).
9. Exhibits to this Agreement (enumerated as follows):
a. Contractor's Bid (pages 1 to 8, inclusive).
b. Documentation submitted by Contractor prior to Notice ofAward (pages to , inclusive).
C.
10. The following which may be delivered or issued on or after the Effective Date of the Agreement and are not
attached hereto:

B. The documents listed in Paragraph 9.01.A are attached to this Agreement (except as expressly noted otherwise

ARTICLE 10 —MISCELLANEOUS
10.1 Terms
A. Terms used in this Agreement will have the meanings stated in the General Conditions and the Supplementary
Conditions.
10.2 Assignment of Contract
A. No assignment by a party hereto of any rights under or interests in the Contract will be binding on another party
hereto without the written consent of the party sought to be bound; and, specifically but without limitation, moneys
that may become due and moneys that are due may not be assigned without such consent (except to the extent that
the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written
consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility
under the Contract Documents.
10.3 Successors andAssigns
A. Owner and Contractor each binds itself, its partners, successors, assigns, and legal representatives to the other
party hereto, its partners, successors, assigns, and legal representatives in respect to all covenants, agreements, and
obligations contained in the Contract Documents.
10.4 Severability
A. Any provision or part of the Contract Documents held to be void or unenforceable under any Law or Regulation
shall be deemed stricken, and all remaining provisions shall continue to be valid and binding upon Owner and
Contractor, who agree that the Contract Documents shall be reformed to replace such stricken provision or part
thereof with a valid and enforceable provision that comes as close as possible to expressing the intention of the
stricken provision.

IN WITNESS WHEREOF, Owner and Contractor have signed this Agreement in triplicate. One counterpart each has been
delivered to Owner, Engineer and Contractor. All portions of the Contract Documents have been signed or identified by Owner
and Contractor or on their behalf.

Each quote is handled on a per order/project basis. Unless a long-term agreement is in place between purchaser and MWP, terms and conditions

Indemnification; Owner/Owner's Representative will indemnify and hold Minnesota Playground, Inc., dba, Minnesota Wisconsin Playground (MWP),
harmless for all claims, damages and related costs, including reasonable legal fees and costs, arising out of Owner/Owner's Representative's
negligence or noncompliance with any of its commitments under this document. MWP will indemnify and hold Owner/Owner's Representative
harmless for all claims, damages and related costs, including reasonable legal fees and costs, arising out of MWP's negligence or noncompliance
with any of its commitments under this document.
Pricing: f.o.b. factory, firm for 15 days from date of quotation. A tax-exempt certificate is needed at time of order entry for all orders whether from
tax -supported government agencies or not. Sales tax, if applicable, will be added at time of invoice unless a tax exempt certificate is provided at
time of order entry.
Unless already on file, please include a tax exempt certificate upon order entry whether a tax supported government agency or other.
2021 Projects: Installations, whether for play equipment or other products of our scope as well as the related services thay may be included with
your project, typically start up in April or May based on weather conditions, road restrictions, etc. Based on the issues being experienced within our
own country, and worldwide, the start of a typical installation year may be jeopardized. Every effort will be made to work with your project time
frame but the various shutdowns will have an effect on work performance throughout the year, not just starting up. Please telephone your company

Project Scope
Please note, installation is based on site being ready prior to our arrival to install play equipment as well as site conditions that have been conveyed
to our organization by the owner/owner's representative and/or ideal conditions existing for a timely completion of your project as quoted. Unless
addressed prior to the installation quote being issued or specifically mentioned herein, any issues that arise that impede the progress/completion of
your project as quoted will result in additional charges.
Weather can change project scheduling in many ways. Take rain for an example. Day, or days, before rain... If weather forecasts show a high
percentage chance for rain that will effect the site conditions, a postponement may be in order. Digging holes, laying certain surfacing materials,
etc., are greatly affected by weather conditions and work may not begin/continue due to weather forecasts. There's the rain days themselves, which
if heavy enough rainfall occurs, makes a site unworkable. Day, or days, after rain... Drying time will be needed after rain and the number of days
needed will vary depending on amount of moisture received. One actual rain day may equal multiple delay days depending on work scheduled to
be done.

Unobstructed space for maneuvering installation equipment as well as performing work
Security fencing of any type unless indicated on quote
If fencing is in place (by others), ability to unlock fencing is to be provided to our office a minimum of one week prior to our start
Private utility locates such as, but not limited to, irrigation, fiber optics, private lighting, etc.
Accepting, unloading and storage of order(s)/shipment(s) prior to installation. Please note, orders can be packaged/shipped in large crates,
pallets, etc., requiring heavy-duty equipment to unload.
Sitework of any kind such as, but not limited to, grading (play area to have max slope of 1 %), site restoration, drainage, etc.
Removal of existing play equipment, border, safety surfacing, etc.
Backfill and compaction of backfill after removal of existing items (for footing holes as an example) that leave voids in area (marking and digging of
new footing holes based on workable site)
Digging in compacted sub -surfaces, rock, hard pan, tree roots, unstable soil conditions, etc.
Restoration of compacted sub -surfaces for playground surfacings such as, but not limited to, poured -in -place rubber, rubber tiles, artificial turf, etc.
Digging/maneuvering in sand, pea gravel, mud, etc.
Offsite removal of spoils from footing holes (can be stockpiled near play area for owner/owner's representative removal or spread within play area)

Materials Surcharge: due to the volatility in various industries such as, but not limited to, those supplying steel, a surcharge is needed to offset
some of the excessive material costs being experienced in our industry, as well as others. This is being looked upon as a short-term necessity but
no guarantees can be given that this surcharge will be removed in the near future. Once costs of materials have returned to the levels in recent
history, the surcharge will be removed.

Cedar Forest Products Shipment: order shall ship within (OPTION A for WOOD - eight to ten weeks) (OPTION B for METAL - ten to twelve
weeks after MWP's receipt and acceptance of your purchase order, color selections, preparation/creation of "stamped" drawings, if required,
approved submittals and receipt of deposit/full payment. Receipt of anything other than what is stated herein will not constitute an order and
therefore no materials will be placed into production nor installation, if required, will be scheduled.

The following terms are expressly part of this proposal and any subsequent agreement between Client and Spohn similarly shall incorporate these
terms. In the event that no further contract is entered into, the terms set forth in the proposal shall constitute the entire agreement between the
parties.
• Acceptance of the work shall be commercially reasonable and expeditious
• Failure to object to work within a reasonable time shall constitute deemed acceptance
• Spohn shall have approval rights as to any initial project schedule, and all subsequent schedule changes
• Spohn shall accept no risk of loss outside of its direct control
• All discretion attributed to Client in any contract shall be subject to commercial reasonableness standard
• Spohn shall not indemnify Client for losses not proximately and solely caused by Spohn
• Spohn must approve any material increases in scope in writing including agreeing to an equitable adjustment of contract price and time
changes in scope in writing
• All modifications, waivers, alterations to be charged against Spohn must be written and signed by Spohn's authorized representative
• Any increase in the price of raw materials anticipated to be used in Spohn's scope greater than ten percent (10%) occurring after execution of
this proposal shall constitute a material changed condition necessitating an equitable adjustment to the contract price
• The price contained in this proposal is valid for ninety (90) days and may be accepted by issuance of a notice to proceed or any similar
instruction whereby Client indicates desire to commence project. The price is further conditioned upon Client's delivery of all items outside
Spohn's scope of work upon which Spohn's work may be predicated.
• Payment terms — 20% upon mobilization, 40% upon 50% completion of scope of work, 35% upon 100% completion of scope of work, 5%
within 30 days of completion of scope of work
• Any payments not made according to terms will be considered delinquent and interest will accrue at the rate of 1.5% per month
• Spohn shall have the right to cure any alleged default within a reasonable time
• Client acknowledges that Spohn is not party to any organized labor agreements. Client agrees that Spohn will not be responsible or liable for
any issues, injuries or damages, relating to labor peace, strikes, picketing or otherwise, regardless as to cause. Client agrees that delays
related to labor issues shall constitute a contractual delay and entitle Spohn to additional time to perform for the length of the delay, and
compensation for any additional costs incurred. These terms are material conditions to Spohn's willingness to provide a proposal to Client.
• In the event that other entities affect the site conditions adversely or impede the progress of the work, the Client shall be responsible for any
additional costs
• Any liability of Spohn which relates to the sale, manufacture, delivery, resale, installation or use of any goods sold by or furnished by Spohn,
whether arising out of contract, negligence, strict tort, under any warranty or otherwise, shall be limited to Spohn's choice of the following:
the repair of the goods; the replacement ofthe goods; the cancellation of the contract, return ofthe goods in question to Spohn, and Spohn's
refund ofthe purchase price
• In no event shall Spohn's liability exceed the price ofthe specific goods upon which the liability is based
• In addition, Spohn shall not, under any circumstances, be responsible for special, consequential, or incidental damages such as, but not
limited to, damage to or loss of other property; loss of profit, revenue or reputation; loss of capital; loss of purchased or replaced goods; or
claims for delays, back charges, or loss of use
• Spohn reserves the right to makes any corrections as necessary to typographic errors
• In the event of any action, suit, arbitration, or other proceeding of any nature is brought in connection with the payment terms related to
these Terms and Conditions, any related agreement, or Spohn's provision of goods, services, products, or to recover any of Spohn's property
("Dispute"), the prevailing party shall be entitled to recover its reasonable attorney's fees, expert -witness fees, other litigation costs and fees
(e.g., deposition costs, trial preparation costs, etc.), and other costs and expenses of suit, judgment or award Any Dispute including the
determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Los Angeles, California, before

one arbitrator. At the option of the first to commence an arbitration, the arbitration shall bead min iste red either by the American Arbitration
Association (AAA) pursuant to its Commercial Rules or by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures. Judgment
on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid
of arbitration from a court of appropriate jurisdiction. The arbitrator shall, in the Award, allocate costs, reasonable attorney's fees, expert -
witness fees, other litigation fees and expenses including the costs of arbitration to the prevailing party in accordance with the Attorney's
Fees provision. Judgment on any arbitration award may be entered by any court of competent jurisdiction.
Spohn shall, at its expense, procure and maintain insurance with carriers acceptable to Client, and in amounts set forth below. Spohn shall
provide certificates of insurance to Client upon request. The certificates of insurance shall provide that there will be no cancellation nor
reduction of coverage without thirty (30) days prior written notice to Client. Required coverage amounts:
o Workers Compensation and Employers Liability insurance in the amount of $1,000,000;
o Automobile Coverage for all Owned, Non -Owned and Hired vehicles in the amount of $1,000,000 per occurrence, $2,000,000
aggregate;
o Comprehensive General Liability or Commercial General Liability insurance covering all operations or job specific in the amount of
$1,000,000 per occurrence, $2,000,000 aggregate;
o Excess Liability/ Umbrella Insurance in the amount of $5,000,000;
o Errors and Omissions/ Professional Liability insurance in the amount of $2,000,000 per occurrence, $2,000,000 aggregate.
These Terms and Conditions are necessarily incorporated by reference into any other related agreement; Client agrees that Iowa law shall
govern the relationship between the Client and Spohn to the fullest extent of applicable law including enforcement of any part of these
Terms and Conditions or any other related agreement between or among Client and Spohn.
Each Term and/or Condition herein is severable in the event one or more provisions are unenforceable for any reason

Mechanical System
Recirculation System $129,486.00
Cartridge Filtration Skid
A pre -plumbed, pre -wired, integrated filtration equipment system mounted on an epoxy coated skid. The
skid to consist of main system control panel, filtration pump with integral hair and lint strainer, automatic
chemical treatment controller, gauges, and flow meter. System to be capable of 85 gpm filtration rates.
Chemical Treatment
To consist of Liquid Chlorine Feeder, Liquid Acid Pump, and (2) Chemical Solution Crock.
Ultra Violet Disinfection System
To consist of a Delta UV disinfection unit that is UL listed, NSF certified and cryptosporidium evaluated,
and EPA registered. Unit has electronic controller that has UV monitors. Unit to be capable of the
filtration flow rate of 85 GPM. To be provided loose. Plumbing and electrical connections by others.
Feature Skid
A pre -plumbed, pre -wired, integrated equipment system mounted on an epoxy skid. System to consist of
a self -priming feature pump with integral hair and lint strainer, check valves, isolation valves, gauges,
and flow switch. System to be capable 293 gpm feature flow rates.
Distribution Manifold
A distribution manifold for all water activities. Manifold to be connected (in the field) to feature pump
discharge and have all discharge lines with manual flow control to water play elements.
Pre -fabricated Water Reservoir
To consist of a 3000 gallon concrete vessel complete with access hatch, access ladder, venting pipes,
floating skimmer, water level control float, overflow outlet, submersible pump out system, inlet loop
manifold, filter and feature pump foot valves, mounting hardware and all piping and electrical
connections specific to project design.
Aquavator
To consist of an activation bollard with touch sensor that will signal control panel to activate feature
supply system for set duration of time.
Control Panel -All On/Off
To be a UL listed control panel that will provide complete operating system power distribution and
system controls for an on/off recirculation system. Panel includes a programmable control system that
will set hours of operation, duration of system run time, and activate water flow via a touch enabled
activation device. Typical electrical requirements for ON/OFF Recirculation systems are 230V
1 Ph/60Htz and 120v 1/Ph 60htz
3 Collector Box
To consist of a 18" diameter PVC basin with grate top. Each collector box has a nominal capacity of
250 gpm gravity supply to water containment vessel.
Rain Diverting Waste Valve Box
Prefab Aboveground Mechanical Enclosure
Perforated aluminum wall panels for ventilation, a single 5-foot wide access door, hidden hardware and
galvalume roof panels. Available in any LSI color with a contrasting roof color. (All Aquatix enclosures
are engineered to withstand wind speeds up to 105mph and snow load up to 5psf.) Note: *Metal
enclosure to be installed on concrete slab by others.
Design Services
Design & Construction drawings: $12,070.00
Including: All design and construction drawings for splash pad project construction to consist of
construction of concrete pad, mechanical system, electrical and control systems, inbed spray fixtures /
collector box installation details, water plays structure assembly / installation on concrete splash pad,
equipment systems installation and hookups.
Splash Pad Design Notes:
1. Aquatix by Landscape Structures design services are based on ideal site locations and conditions.
2. Aquatix by Landscape Structures design services do not include soil corrections, demolition planning,
site elevation plans, utility planning / design or relocation of utilities. (i.e. based on water, waste and
power being available at designed area's of splash pad by others.)
3. All permits and costs of permits are not included in our splash pad design package.
4. Design package will be prepared based on Aquatix's interpretation of Local health code.
5. Pricing include sealed Engineer Stamp.
6. The fee for design services is non-com issionable.

*RETURN POLICY: As an indication of our commitment to our customers, Aquatix by Landscape
Structures will accept returns of new structures and/or new equipment purchased within 60 days of the
original invoice date. Advance notification is necessary to ensure proper credit. Parts not included in
this return policy are custom parts, as well as used or damaged parts. A 20% restock fee plus all
return freight charges will apply to all product returns. NOTE: All parts are subject to inspection upon
return. Parts returned damaged may not receive a full credit. For this reason, it is important that all
returned parts are properly packaged to prevent damage while in transit.

• State Health Department submission and review fee's.

• Site drainage as needed to prevent wash -outs, damage to installation work.
• Stripping of site vegetation and top soil. These materials to be stock piled on site.
• Installation and compaction of granular fill under splash pad.
• Bulk excavation, placement and backfilling for underground water reservoir.
• Bulk excavation and backfilling of plumbing trenches.

• Grounding requirements for splash pad reinforcement, embeds and systems.
• Final hookup of water supply line to system mechanical float valve at water tank.
• Final hookup of waste piping from equipment systems and components.
• Final clean up of splash pad, equipment room and underground water reservoir prior to system startup.
• Splash pad system startup and balancing.
• Splash pad final site inspections as required by City and State Health Departments scheduling and
overview.
• Splash pad system operation instructions to owner's personnel. (Recommend owner to video tape this
training)

Statement of Work
1.PTD to install cabling, new headend, Ian module for communication, door contacts, rex detectors, card readers and wire in the electrified
door hardware being provided and installed by others on 5 doors as indicated on prints.
These doors will be programed as a new location within the City's main DSX instance.
Door hardware, Electrical rough -in, conduit, pathway, coring, sleeving, 110 tie in, and grounding buss to be provided by others .
System design assumes all electrified door hardware that is being supplied and installed by others will be low voltage requiring 24VDC.
Exclusions
OUTAGES: Customer understands that over the course of this project that there may be outages as doors are being installed
STANDARD DOOR: Solution assumes a standard door deployment of a Card Reader, a Door Contact, an Electrified Lock, and a Rex.
Deployments beyond this standard will be billed on a T&M basis.
NETWORK: Owner shall provide all network connectivity, infrastructure, not limited to and including, IP addresses, switches Router,
Gateway, Firewall, and POE (when applicable). Any programming of VLANs, Firewall exclusions, and port forwarding, if applicable shall be
provided by customer.
POWER: 110VAC power and connection needs shall be provided by owner.
SUPPORT: Owner shall provide any technical assistance need during project. This includes IT staff providing access to workstations and
servers.
PROGRAMMING: Owner shall program all system information including, but not limited to, cardholder name, access privileges, and other
system information not stated in scope.
DOOR HARDWARE: All door hardware shall be provided and installed by others..
NEC/NFPA/IBC: Project shall follow all applicable building and fire codes. This may require the client to coordinate with associated trades
not specified in this scope.
WORK HOURS: This bid assumes technicians shall have access during an 8hr shift and be able to work between the core hours of 6am
and 4pm Monday through Friday. If after hours or weekend labor is required, a different rate shall apply.
PARTITIONS: If work is taking place in areas where partitions, negative air, or dust remediation is required, it shall be provided by others.
PERMITS: Work in special areas that requires local permits are to be provided by others.
PENETRATIONS, CORING, & SLEEVING: Where existing pathway does not exist or requires expansion, any firewall penetrations,
sleeving, and concrete coring shall be provided by others.
DEMOLITION: Removal of cabling, where needed shall be done by others or can be quoted separately by request.
ELECTRICAL: Customer Shall provide an electrician to hardwire power where needed.
PATCHING: Any remediation, patching and painting of walls, replacement of ceiling tiles or other surfaces shall be provided by others.
CABLE: All conduit, cable tray, wire mold, fiber, and junction/back boxes shall be provided and installed by others.
FIRE: Customer shall provide a Fire vendor for any fire tie-ins or related work that is needed or required.

2021 Projects: Installations, whether for play equipment or other products of our scope as well as the related services thay may be included with
your project, typically start up in April or May based on weather conditions, road restrictions, etc. Based on the issues being experienced within our
own country, and worldwide, the start of a typical installation year may be jeopardized. Every effort will be made to work with your project time
frame but the various shutdowns will have an effect on work performance throughout the year, not just starting up. Please telephone your company

Project Scope
Please note, installation is based on site being ready prior to our arrival to install play equipment as well as site conditions that have been conveyed
to our organization by the owner/owner's representative and/or ideal conditions existing for a timely completion of your project as quoted. Unless
addressed prior to the installation quote being issued or specifically mentioned herein, any issues that arise that impede the progress/completion of
your project as quoted will result in additional charges.
Weather can change project scheduling in many ways. Take rain for an example. Day, or days, before rain... If weather forecasts show a high
percentage chance for rain that will effect the site conditions, a postponement may be in order. Digging holes, laying certain surfacing materials,
etc., are greatly affected by weather conditions and work may not begin/continue due to weather forecasts. There's the rain days themselves, which
if heavy enough rainfall occurs, makes a site unworkable. Day, or days, after rain... Drying time will be needed after rain and the number of days
needed will vary depending on amount of moisture received. One actual rain day may equal multiple delay days depending on work scheduled to
be done.

If fencing is in place (by others), ability to unlock fencing is to be provided to our office a minimum of one week prior to our start
Private utility locates such as, but not limited to, irrigation, fiber optics, private lighting, etc.
Accepting, unloading and storage of order(s)/shipment(s) prior to installation. Please note, orders can be packaged/shipped in large crates,
pallets, etc., requiring heavy-duty equipment to unload.
Sitework of any kind such as, but not limited to, grading (play area to have max slope of 1 %), site restoration, drainage, etc.
Removal of existing play equipment, border, safety surfacing, etc.
Backfill and compaction of backfill after removal of existing items (for footing holes as an example) that leave voids in area (marking and digging of
new footing holes based on workable site)
Digging in compacted sub -surfaces, rock, hard pan, tree roots, unstable soil conditions, etc.
Restoration of compacted sub -surfaces for playground surfacings such as, but not limited to, poured -in -place rubber, rubber tiles, artificial turf, etc.
