87-048 RES RESOLUTION 87-48 RESOLUTION ACCEPTING 2l8TH AVENUE AS A CITY PUBLIC STREET AND ORDERING GRAVEL IMPROVEMENTS ON 2l8TH AVENUE . WHEREAS, the Elk River City Council, on December 17, 1984, received and accepted a 100% petition from property owners on 2l8th Avenue requesting the City to accept 2l8th Avenue as a municipal public street, and; WHEREAS, Council action on December 17, 1984, directed the City Street Department to begin performing maintenance on 2l8th Avenue, and the City to plan the gravel improvement for 2l8th Avenue, which included the obtaining of needed right-of-way easements, for the 1985 construction season, and; WHEREAS, the City has maintained 2l8th Avenue since this December 17, 1984, Council Meeting, but the gravel improvements have not taken place, and; WHEREAS, on August 24, 1987, the Elk River City Council again received a 100% petition from the assessable property owners requesting the previously committed gravel improvements to be completed and waiving the property owners rights to a public hearing and waiving the property owners rights to object to the assessment of said improvements, and; . WHEREAS, the City Council of the City of Elk River now desires to follow through with the gravel improvement as agreed upon in 1984, and; WHEREAS, it has been determined by the City Council of the City of Elk River that the gravel improvement of 2l8th Avenue is not in conflict with the approved 8/10/87 City assessment policy as the City is following through on a previous committment prior to the adoption of this assessment manual, and; WHEREAS, the City Engineer and the City Street Superintendent has determined that the gravel improvements on 2l8th Avenue can be accomplished for an amount not to exceed $2,800 for material and labor. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River that the City Street Crew is hereby authorized to complete the gravel improvements to 2l8th Avenue, and once completed, that 2l8th Avenue is accepted as a municipal public street. BE IT FURTHER RESOLVED by the City Council of the City of Elk River that this improvement is not considered to be inconsistent with the adopted 8/10/87 City assessment manual as the commitment to improve 2l8th Avenue was done on December 17, 1984, pending the City obtaining adequate easements. . . . . Resolution 87-48 Page Two BE IT FURTHER RESOLVED by the City Council that the Elk River Street Crew will complete the gravel improvements at a cost not to exceed $2,800 for material and labor, and that the cost of said gravel improvement is to be assessed to the four benefited property owners as determined on December 17, 1984, pursuant to Minnesota Statutes, Section 429 and the City Administrator is hereby authorized to prepare an assessment roll for this improvement project.
