Background/Discussion The City Council held a public hearing on April 19, 2021, for a lot split request in Osberg Acres and unanimously approved the request. Sherburne County is requesting a certified resolution to facilitate the recording and memorialize Council approval. The resolution is attached and recommended for approval. Background/Discussion CR 33 Case Number LS 21-01 The subject property, 9.03 acres in size, is zoned R-la and is currently a platted lot. The proposed lot split will create two buildable lots, and the RR splitting of an existing lot is permitted under the ordinance as a Lot Split. Parcel A will retain the existing home and Parcel B will be sold for Hwy 10 development, both lots meet minimum frontage and size standards. All cR 12 access for the new buildable parcel will come from the east — Grant Street NW. The buildable lot is eligible for park dedication and the Parks and �P Recreation Commission recommended cash dedication. tiwy /69 Applicable Regulations 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, as follows: Findings of fact: A. The proposed subdivision is consistent with Chapter 30 of the City Code of Ordinances and conforms with all its requirements. B. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the city's Comprehensive Plan. C. The physical characteristics of the site, including, but not limited to, topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. D. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. 2. Lot split approval is hereby granted for the Property. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to issue a certified copy of this Resolution giving final approval of the lot split. 4. The owner of the Property is authorized to record this resolution and the certificate of survey as required by law and shall file proof of recording the certificate of survey with the City. No building permits will be issued for the Property until the certificate of survey is recorded. This lot split approval shall expire two years from the date of this resolution if the certificate of survey is not recorded within that time. Passed and adopted this 3rd day of May 2021. John J.
