Background/Discussion Earlier this year the City Council approved a Conditional Use Permit (CUP) and Plat to facilitate expansion of Elk River Municipal Utilities (ERMU) Field Services Facility. The Field Services Facility is a Government Facility, which is allowed with a CUP in the subject zoning district—R-1c (Single-Family Residential). The Field Services Facility is also consistent with the Comprehensive Plan,which guides the property for residential uses as part of the Mississippi Connections Plan. Due diligence completed prior to recording the plat that will establish the buildable parcel for ERMU's expansion identified the City and Village of Elk River as the owner of four parcels. In order to complete the platting process for ERMU,the city will provide a quit claim deed to ERMU to relinquish the city's interest in these parcels. The transfer of the parcels to ERMU requires approval from City Council and, consistent with state statute,a resolution from the Planning Commission finding the proposed use to be consistent with the Comprehensive Plan. Updated.August 2020 City of Elk ^--� City of Elk River River Planning Commission Resolution 21-03 A Resolution of the Planning Commission of the City of Elk River Finding that the Transfer of Property is Consistent with the Elk River Comprehensive Plan WHEREAS, The City,of Elk River ("City,") has agreed to terms with Elk River Municipal Utilities ("ERMU") for the transfer of the parcels identified in Exhibit A ("Property,"); and WHEREAS, the City,would transfer the Property,for continued use and development as a Government Facility,,which is a Conditional Use in the Property's zoning district; and WHEREAS, Minn. Stat. 462.356, subd. 2 requires the Planning Commission to review the City's proposed disposition of property,for consistency with the Comprehensive Municipal Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City,of Elk River, Minnesota, as follows: The transfer of the Property,described in Exhibit A is consistent with the Comprehensive Municipal Plan.
