A Resolution of the Planning Commission of the City of Elk River Finding
that the Transfer of Property is Consistent with the
Elk River Comprehensive Plan
WHEREAS, The City of Elk River ("City") has agreed to terms with Elk River Municipal
Utilities ('ERMU") for the transfer of the parcels identified in Exhibit A ('Property"); and
WHEREAS, the City would transfer the Property for continued use and development as a
Government Facility, which is a Conditional Use in the Property's zoning district; and
WHEREAS, Minn. Stat. 462.356, subd. 2 requires the Planning Commission to review the
City's proposed disposition of property for consistency with the Comprehensive Municipal
Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Elk River, Minnesota, as follows: The transfer of the Property described in Exhibit A is
consistent with the Comprehensive Municipal Plan.

Exhibit A
Parcel 1: All that part of Lot 1, Block 2, Auditor's Addition to the Village of Elk River, described
as follows: Commencing at the Northwest corner of said Block 2; thence Southeasterly along
the North line of Block, 90 feet; thence Southerly parallel with the East lines of Lots 1, 2, 3, & 4
of said Block 2 a distance of 243 feet to the point of beginning; thence Easterly at right angles
to said last described course 42 feet to the East line of Lot 1; thence Southerly along said East
line to the North line of Depot Street; thence Southwesterly and Northwesterly along the North
line of Depot Street to the Southwest corner of Lot 1; thence Northeasterly along the West line
of said Lot 1 to a point which is 232 feet Southwesterly from the Northwest corner of Block 2;
thence Southeasterly to the point of beginning.
Parcel 2: Lots 1,2,3 & 4, Block 1, Auditor's Addition, according to the plat thereof on file and of
record in the office of the County Recorder, Sherburne County, Minnesota.
Parcel 3: Lots 5 & 6, Block 1, Auditor's Addition, according to the plat thereof on file and of

Parcel 4: Lots 7 & 8, Block 1, Auditor's Addition, according to the plat thereof on file and of
